CITY OF PLYMOUTH
RESOLUTION NO, 96 - 516
AUTHORIZING THE VACATION OF
DRAINAGE, PONDING, AND UTILITY EASEMENT
OUTLOT F - FERNBROOK WOODS 2"D ADDITION
WHEREAS, a petition was received to vacate the drainage, ponding, and utility easement in
Outlot F, Fembrook Woods 2nd Addition; and
WHEREAS, said petition was signed by a majority of the owners of the land abutting the area
proposed to be vacated; and
WHEREAS, a public hearing with respect to said vacation was scheduled for September 18,
1996 in accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks prior
to the meeting of September 18, 1196; and
WHEREAS, all property owners adjacent to the propnsed vacation were duly notified by mail;
and
WHEREAS, the Council did hold a public hearing on September 18, 1996 to inform any and
all interested parties relevant to the vacation of drainage, ponding, and utility easement in
Outlot F, Fembrook Woods T1 Addition; and
WHEREAS, it was determined by the City Council that said easements were not needed for
public purposes;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PLYMOUTH, MINNESOTA: That the following drainage, ponding, and utility
easement be vacated:
The drainage, ponding, and utility easement within Outlot F, FERNBROOK
WOODS 2N° ADDITION, according to the plat on file or of record in the office
of the Registrar of Titles, Hennepin County, Minnesota.
Adopted by the City Council on September 18, 1996.
