FOR PROPERTY LOCATED SOUTHWEST OF THE INTERSECTION OF CHESHIRE LANE AND CARLSON PARKWAY (95133) WHEREAS, Carlson Real Estate has requested approval of a Variance for property legally described as follows: South part of Oudot D, Carlson Center Second Addition. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HERE7. ? RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Carlson Real Estate for a Variance subject to the following conditions: 1. A Variance from the Subdivison Code is granted for the creation of lots without frontage on a public street (Lots 4 and 5, Block I Carlson Business Center North). The Variance is based on the finding that: A. There are special circumstances that affect this property regarding restricted access to I-494. B. The Variance is necessary for the preservation and enjoyment of a substantial property right by the applicant. C. The Variance will not be detrimental to the public welfare ar injurous to other property.
