RESOLUTION NO. 96 - 5 ! o
DECLARING PROPERTY 8 URPL U: , AND
AUTHORIZING CONVEYANCE OF THE SURI'LUS PROPERTY TO THE
ADJOINING LAND OWNER
CITY PROJECT NO, 310
WHEREAS, the City purchased approximately 314 of an acre of land from Naegele Outdoor
Advertising Company in 199; and
WHEREAS, approximately .13 of an acre of this property will not be needed by the City; and
WHEREAS, the City has reached a tentative agreement with the owner of Dundee Nursery to
swap this excess parcel for right-of-way needed over approximately .07 of an acre of Dundee
property; and
WHEREAS, it is in the best interest of the City to swap the excess Naegele property for the
Dundee property needed rather than pay cash.
WHEREAS, resolution 94-326 was not recorded at the County due to the legal descriptions
were not attached to the resolution.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PLYMOUTH, MINNESOTA: That the above described property is hereby declared
surplus and that authority is granted to swap and convey the above described property to Dundee
Landscaping Company for right-of-way over Dundee property. The surplus property, legally
described in Exhibit A, shall be combined with the adjoining Dundee property, legally described
in Exhibit B, to become one tax parcel.

That part of the following described property:
That part of the southeast quarter of the southwest quarter of Section 17, Township 118
north, Range 22 west of the 5th Principle Meridian described as follows: Beginning at
the southeast comer of the southeast quarter of the southwest quarter of said Section
17; thence north along the east line of the said southeast quarter, a distance of 247.5
feet; thenot west, parallel to the south line of said southeast quarter of the southwest
quarter, a distance of 264 feet; thence south, parallel with the east line of said southeast
quarter of the southwest quarter, a distance of 247.5 feet to the south line of said
southeast quarter of the southwest quarter; thence east along the south line of the said
southeast quarter of the southwest quarter a distance of 264 feet to the point of
beginning, according to the United States Government Survey thereof, Hennepin
County, Minnesota.
Lying northerly of the following described line:
Commencing at the northeast comer of said described property; thence north along the
east line of said southwest quarter 111.38 feet to the point of the beginning of the line
to be described; thence southwesterly to a point on the north line of said described
property a distance of 108.16 feet westerly from the northeast corner of said described
property; thence continuing southwesterly along the extension of the last described line
40 feet; thence southwesterly on a deflection angle of right 30 degrees 00 minutes 00
seconds to the west line of said described property and said line there terminaing.

17, Township 118 North, Range 22 west of the 5th Principle Meridian, lying east of
the west 552 feet thereof, also that part of the south half of the southeast quarter of the
southwest quarter of said Section 17 commencing at the northeast corner; thence south
to a point 247.5 feet north from the southeast corner thereof; thence westerly 264 feet;
thence south to the northerly right of way line of Trunk Highway No. 55; thence
northwesterly along said northerly right-of-way line to the north line of the south half
of the southeast quarter of the southwest quarter of said Section 17; thence easterly to
the point of beginning.
