CITY OF PLYMOUTH
RESOLUTION NO. 96 - 485
AUTHORIZING THE VACATION OF
PART OF 30TH AVENUE NORTH
(NOW KNOWN AS 31sT AVENUE NORTH) RIGHT-OF-WAY IN
BLOCK 2, PLAYHOUSE INDUSTRIAL PARK
WHEREAS, a petition was received to vacate part of 30m Avenue North (now known as 311
Avenue North) right-of-way in Block 2, Playhouse Industrial Park; and
WHEREAS, said petition was signed by a majority of the owners of the land abutting the area
proposed to be vacated; and
WHEREAS, a public hearing with respect to said vacation was scheduled for September 4, 1996 in
accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to
the meeting of September 4, 1996; and
WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and
WHEREAS, the Council did hold a public hearing on September 4, 1996 to inform any and all
interested parties relevant to the vacation of part of 3e Avenue North (now known as 311 Avenue
North) right-of-way in Block 2, Playhouse Industrial Park; and
WHEREAS, it was determined by the City Council that said easements were not needed for public
purposes;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA; That the following vacation of part of 3& Avenue North (now
known as 311 Avenue North) right-of-way in Block 2, Playhouse Industrial Park be vacated:
That part of 3e Avenue North originally dedicated in the recorded plat of
PLAYHOUSE INDUSTRIAL PARK (now known as 311 Avenue North) which lies
easterly of the southerly extension of the easterly line of the westerly 292.00 feet of
Lot 2, Block 2 in said recorded plat and lying westerly of the southerly extension of
the easterly line of Lot 1 Block 2 in said recorded plat.
FURTHER, that said vacation shall not affect the authority of any person, corporation, or
municipality owning or controlling the electric or telephone poles and lines, gas and sewer
lines, water pipes, mains and hydrants thereon or thereunder, to continue maintaining the
same, to enter upon such way or portion thereof vacated to repair, replace, remove
otherwise attend thereof.
