RESOLUTION 96. 462
APPROVING VARIANCE FOR DAVID JOHNSON FOR PROPERTY LOCATED
AT 17435 COUNTY ROAD NO. 6 (HERB'S SERVICE CENTER INC.) (96102)
WHEREAS, David Johnson has requested approval of a 9.5 -foot Variance to the
required front yard setback of 20 feet, in order to construct a free standing business
sign; and
WHEREAS, the subject property is legally described as Lot 1, Block 1, Oakwood
Square; and
WHEREAS, the Planning Commission has reviewed said request at a duly called Public
Hearing and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve
the request by David Johnsnn for a Variance based on the trading that the Variance
Standards have been met, suuject to the following:
1. The Variance allows construction of a free-standing basiness sign with a front yard
setback of 10.5 feet, versus the Sign Ordinance requirement of 20 feet, in
accordance with the application received by the City on July 3, 1996.
2. The property is unique in character in that it is a corner lot intersecting two minor
arterial roadways (County Roads 6 and 101).
3. A particular hardship to the owner has been demonstrated due to the lot line
configuration along the intersection combined with the required setbacks for
parking.
4. The placement of the proposed sign will not interfere with traffic visibility or
impede safety by obstructing vision of pedestrians or motor vehicle operators.
5. This would not establish an undesirable precedent within the City.
