APPROVING A SITE PLAN AMENDMENT AND VARIANCE FOR WELSH
COMPANIES, FOR PROPERTY LOCATED AT 14700 28TH AVE. N. (96101)
WHEREAS, Welsh Companies has requested a Site Plan Amendment and Variance to
allow a parking lot expansion on property legally described as Lot 4, Block 1, Circle
Star Business Center, 2nd Addition, Hennepin County, Minnesota; and,
WHEREAS, the Planning Commission has reviewed said request at a duly called Public
Hearing and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve
the request by Welsh Companies for a Site Plan Amendment and Variance, subject to
the following conditions:
1. The Site Plan Amendment approval is for a 19 -space parking lot expansion,
according to the plans received by the City on July 18, 1996, except as amended by
this resolution.
2. A Variance is granted for an 18 -foot parking setback to the front property line. The
request meets the Variance standards. Specifically:

A. The unusual design of the building restricts the use of the building to a more
limited type of tenant than would a more traditional industrial building.
B. The Variance is not based exclusively upon a desire to increase the income
potential of the building but to mitigate a design feature that was needed for a
tenant that has subsequently moved from the building.
C. The Variance would not be detrimental to the public welfare or injurious to
other land,
D. The Variance will not increase traffic congestion.
E. The Variance will not impair property values in the neighborhood.
4. Standard Conditions:
A. Compliance with the City Engineer's Memorandum.
B. Compliance with Policy Resolution 79-80 regarding minimum floor elevations
for new structures on sites adjacent to, or containing any open storm water
drainage facility.
C. Submission of required Financial Guarantee and Sit= Performance Agreement
for completion of site improvements within twelve months of the data of this
resolution.
D. Any signage shall be in compliance with the Ordinance.

E. Any subsequent phases or expansions are subject to requiredreviews and
approvals per Ordinance provisions.
F. Compliance with all Fire Codes and policies, including thoseregarding the
location of fire hydrants and fire lane signage.
G. An 81/2 x 11 inch "As Built' Fire Protection Plan shall besubmitted prior to
the release or reduction of any site improvement bonds per City Policy.
H. Compliance with State and Federal requirements for handicapped parking
requirements.
