CITY OF PLYMOUTH
RESOLUTION 96- 460
APPROVING VARIANCE FOR DANIEL AND CHERYL SCHRADER FOR
PROPERTY LOCATED AT 1429 WEST MEDICINE LAKE DRIVE (96100)
WHEREAS, Daniel and Cheryl Schrader have requested approval of a Variance to
allow a front yard setback of 13 feet for the construction of a 14 -foot by 14 -foot three -
season porch and a 12 -foot by 12 -foot deck, where 25 feet is required by the Zoning
Ordinance; and
WHEREAS, the subject property is legally described as Lot 10, Block 1, Elmhurst
Gateway; and
WHEREAS, the Planning Commission has reviewed said request at a duly called Public
Hearing and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve
the request by Daniel and Cheryl Schrader for a Variance based on the finding that the
Variance Standards have been met, subject to the following:
1. The Variance allows a front yard setback of 13 feet for the construction of a 14 -foot
by 14 -foot three -season porch and a 12 -foot by 12 -foot deck, in accordance with the
application received by the City on July 2, 1996.
2. The property is unique in character due to the physical lot size and narrow
dimensions which occurred as a result of the platting during the early 1900's.
3. A particular hardship to the owner has been demonstrated due to the physical
surroundings, narrow dimensions and topographical conditions of this specific
parcel.
4. The combination of the lot dimensions and the required setbacks create a physical
constraint for the expansion of any addition onto the home with the Ordinance
standards.
5. This would not establish an undesirable precedent within the City.
