HomeMy WebLinkAboutCity Council Resolution 1996-440• CITY OF PLYMOUTH RESOLUTION 96 - 440 APPROVING A RPUD FINAL PLAN/PLAT AND DEVELOPMENT CONTRACT FOR LUNDGREN BROTHERS CONSTRUCTION INC. FOR PLUM TREE 2ND ADDITION LOCATED AT THi NORTHWES'r QUADRANT OF PEONY LANE AND OLD ROCKFORD ROAD (96103F) WHEREAS, Lundgren Bros. Construction Inc. has requested approval of a Residential Planned Unit Development Final Plan/Plat for the Plum Tree 2nd Addition located at the northwest quadrant of Peony Lane and Old Ruckford Road; and, WHEREAS, the City staff has prepared a Development Contract covering the improvements related to said plat; NOW, THEREFORE, BE IT HEREBY RESOLVED BY TFE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the Final Plan/Plat ;,ad Development Contract for the Plum Tree 2nd Addition for property located at the northwest quadrant of Peony Lane and Old Rockford Road; and, FURTHER, that the Development Contract for said plat be approved, and that the Mayor and City Manager be authorized to execute the Development Contract on behalf of the City; and, FURTHER, that the following conditions he met prior to recording of, and related to said plat: 1. This Final Plan/Plat approval is for the creation of 19 lots in the Plum Tree 2nd Addition. 2. Approval of a Wetland Mitigation Plan prior to the issuance of grading permits. 3. Maximum lot coverage shall be 25 percent. 4. Prior to issuance of building permits on each individual lot, buffer monuments shall tN placed in accordance with Section 6, Subdivision C.7 of the Zoning Ordinance. 5, A 28 -foot back to back street width design is approved for 46th. Ave. N. and Rattier Court N. 6. A six-foot concrete sidewalk shall be constructed by the developer as shown on the street construction pians received by the City on July 3, 1996. The sidewalks shall be located on the ;forth side of 46th Ave. N. The Homeowners Association shall be responsible for cite maintenance of all sidewalks. • • 96103F, Page 2 7. Development Standards: A. 25 -foot front yard setback B. 6 -foot side yard setback to garages C. 9 -foot side yard setback to living space D. 20 -foot rear yard setback E. 25 -foot wetland rear yard setback F. 10 -foot wetland side yard setback G. 10 -foot average buffer 8. Disclosure documents for this development shall include specific reference to the Soo Line Railroad tracks and the Peony Lane bridge over the railroad. 9. Standard Conditions: A. Compliance with City Engineer's Memorandum. B. Removal of all hazardous trees from the property at the owner's expense. C. No building, permit shall be issued until a contract has been awarded for sewer and water. D. Street names shall comply with the City Street Naming System. E. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. F. No building permits shall be issued until the Final Plat is filed and recorded with Hennepin County. G. Final Plat mylars shall refer to RPUD 95.1. H. Location and number of fire hydrants shall be approved by the Fire Division. I. Submission of a Site Improvement Performance Agreement prior to issuance of building permits for common landscaping recreational features and butter munumentation. J. Appropriate legal documents regarding Homeowners Association documents, covenants and restriction as approved by the City Attorney shall be flied with the Final Plat. Specific reference shall be made to the maintenance of the active recreational fearures, common landscaping, the landscaping in street islands and all sidewalks or trails. K. The Developer shall (told the City and its officers, employees, and agents harmless from claims made by itself and third parties for damages sustained or costs incurred resulting from plat approval and development. The Developer shall Indemnity the City and its officers, employees, and agents for all costs, damages, or expenses which the City may pay or incur in consequence of such claims, including attorneys' fees. Compliance with the terms of City Council Resolution 89439 regarding tree preservation. N. The Development Contract, as approved by the City Council, shall be fully executed prior to release of the Final Plat. Adopted by the City Council on August 21, 1996.
