RESOLUTION NO. 96- 4P9
APPROVAL OF EAST CO. RD. 9 STREETSCAPE IMPROVEMENT PLANTING
WHEREAS, the City Council desires to construct certain Streetscape improvements, including
the Bast Co. Rd. 9 Streetscape Improvement planting, within Hennepin County right of way
along County State Aid Highway No. 9; and
WHEREAS, Hennepin County has agreed to allow the construction of the proposed
improvements if the City of Plymouth assumes all responsibility for the maintenance and
repair and holds Hennepin County harmless for all claims, judgments and actions arising out
of the negligent performance of the City, its Contractor, its employees and its officers in the
construction and maintenance of the Streetscape improvements.
NOW, THIMEFORB, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PLYMOUTH, MINNESOTA, that the City assumes all legal liability for the
existence of the Bast Co. Rd. 9 Streetscape improvements within Hennepin County right of
way and hereby saves, defends and holds harmless Hennepin County against all claims,
demands, judgments, fines, penalties, expenses, actions or causes of action of any kind out of
or by reason of the construction and existence of the Streetscape improvements.
FURTHER, the Bast Co. Rd. 9 Streetscape improvement project begin Fall '96; first phase
funding from Acct. 101-125-810.26, and future phases completed in a timely manner as
funding becomes available.
