RESOLUTION CORRECTING THE LEGAL DESCRIPTION OF
A DRAINAGE AND UTILITY BASM43NT RESERVED BY
CITY RESOLUTION 87-117 DATED APRIL 6, 1987 AND
RECORDED AS DOCUMENT NO. 1839045
WHEREAS, pursuant to City Resolution No. 87-217, passed and
adopted on April 6, 1987, the Plymouth City Council vacated a
portion of a public right-of-way known as Larch Lane, lying
adjacent to Lot 61 Blo.k 2, Rappaport Addition; and
WHEREAS, City Resolution No. 87-217 also provided as
follows: "AND FURTHER BE IT RESOLVED, that a 20 -foot utility and
drainage easement shall be maintained over the Southeasterly 20
feet of said street"; and
WHEREAS, the Hennepin County Examiner of Titles has
determined that the reservation of easement language in
Resolution 87-217 is ambiguous and must be clarified; and
WHEREAS, it is in the public interest to accurately describe
the easement and to correct the ambiguity in the legal
description as it appeared in City Resolution 87-217;
NOW, THERNFORE, BE IT RESOLVED by the City Council of the
City of Plymouth:
1. The legal description of the easement reserved in City
Resolution 87-217, dated April 6, 1987 and recorded
with the Hennepin County Registrar of Titles as
Document No. 1839045 is ambiguous.
J. That the correct legal description for the drainage and
utility easement is as follows:
A 20 -foot utility and drainage easement over the
southerly 20 feet of that portion of Larch Lane
dedicated in the plat of Rappaport Addition, Hennepin
County, Minnesota,

3. That this Resolution shall amend Resolution 87-217 in
respect to the easement reservation and the City Clerk
is directed to file a certified copy of this Resolution
with the County Registrar.
ADOPTED this 7th day of August 1996, by the City
Council of the City of Plymouth.
