HomeMy WebLinkAboutCity Council Resolution 1996-410C CITY OF PLYMOUTH RESOLUTION NO. 96- 410 RESOLUTION APPROVING ENCROACHMENT AGREEMENTS FOR FENCES IN CITY TRAIL OUTLOT BETWEEN 17020 AND 17100 lr AVENUE NORTH WHEREAS, it has been discovered that privacy fences have been built by the abutting homeowners close to a trail owned by the City of Plymouth lying north of 10 Avenue North (Outlot B, Oakdale West Addition); and WHEREAS, upon inspection, it was determined that the fences had been built without permits and extended beyond the property line; and WHEREAS, acting on advice from City staff, the homeowners have moved the fences away from the trail, but the fences are still within the Oudot owned by the City of Plymouth; and WHEREAS, it has been found to be in the best interests of the homeowners and of the City of Plymouth to permit the fences to remain in the outlot; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that the Mayor and Clerk are hereby authorized to sign, on behalf of the City of Plymouth, encroachment agreements that will permit the fences to remain on the City's outlot; and FURTHER, BE IT RESOLVED, that the encroachment agreements shall be recorded with Hennepin County, and after they have been recorded staff shall issue building permits for the privacy fences.
