HomeMy WebLinkAboutCity Council Resolution 1996-4080 CITY OF PLYMOUTH RESOLUTION % -408 APPROVING RPUD FINAL PLAN/PLAT AND DEVELOPMENT CONTRACT FOR ABINGDON DEVELOPMENT CORPORATION FOR PROPERTY LOCATED AT 4005 COUNTY ROAD 101 (96093)(RPUD 94-1) WHEREAS, Abingdon Development Corporation has requested a Final Plan/Plat for The Orchards of Plymouth 2nd Addition located at 4005 County Road 101; legally described as : Lot 1, Block 16, Orchards of Plymouth, Hennepin County, Minnesota and, WHEREAS, the City staff has prepared a Development Contract covering the improvements related to said plat; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the Final Plan/Plat and Development Contract for The Orchards of Plymouth 2nd Addition located at 4005 County Road 101, and, FURTHER, that the Development Contract for said plat be approved, and that the Mayor and City Manager be authorized to execute the Development Contract on behalf of the City. FURTHER, that the following conditions be met prior to recording of, and related to said plat: 1. RPUD Final Plan/Plat approval is hereby granted for the Orchards of Plymouth 2nd Addition in accordance with the plans received by the City on June 19, 19969 except as amended by this resolution. 2. Approved setbacks are: A. 30 -foot front yard setback from the right-of-way line, except a 25 -foot front yard setback is approved for Block 1; H. 20 -foot setback between structures; and, C. 20 -foot setback to wetlands. 3. Maximum impervious coverage shall be 75 percent for the twin homes. 4. Standard Conditions: A. Compliance with the City Engineer's Memorandum. B. Removal of all hazardous trees from the property at the owner's expense. E 0 C. No building permits shall be issued until a contract has been awarded for municipal sewer and water, and the MPCA permit issued. D. No building permits shall be issued until the Final Plat has been filed and recorded with Hennepin County. E. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. F. Street names shall comply with the City Street Naming System. G. The Final Plat mylars shall contain a statement noting that the plat is part of the approved RPUD 94-1, per Section 9 of the Zoning Ordinance. H. Submittal of required utility and drainage easements as approved by the City Engineer prior to filing the Final Plat. 1. Appropriate legal documents regarding Homeowner Association documents, covenants and restrictions, as approved by the City Attorney, shall be filed with the Final Plat. J. Compliance with the terms of City Council Resolution 89439 regarding Tree Preservation. K. The Development Contract, as approved by the City Council, shall be fully executed prior to release of the Final Plat. L. No yard setback variances are granted or implied. M. The Developer shall hold the City and its officers, employees, and agents harmless from claims made by the developer and third parties for damages sustained or costs incurred resulting from plat approval and development. The Developer shall indemnify the City and its officers, employees, and agents for all costs, damages, or expenses which the City may pay or incur in consequence of such claims, including attorneys' fees.
