HomeMy WebLinkAboutCity Council Resolution 1996-403U Crf"Y OF PLYMOUTH RESOLUTION 96- 403 APPROVING AN MPUD PRELIMINARY PLAN AMENDMENT, CONDITIONAL USE PERMIT AMENDMENT AND FINAL PLAN AMENDMENT FOR HOLLE CONSTRUCTION CO. INC. FOR PROPERTY LOCATED AT 2700 CAMPUS DRIVE (96080) WHEREAS, Holle Construction Co. Inc. has requested an MPUD Preliminary Plan Amendment, Conditional Use Permit Amendment and Final Plan Amendment for property legally described as follows: Lot 1, Block 1, Northwest Business Campus, 9th Addition, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Holle Construction Co. Inc, for an MPUD Preliminary Plan Amendment, Conditional Use Permit Amendment and Final Plan Amendment for property located at 2700 Campus Drive subject to the following conditions: 1. This approval permits the addition of 19,200 square feet to the existing 33,868 square - foot Burgess Industries building, in accordance with the plans received by the City on June 29, 1996, except as amended by this resolution. 2. Impervious coverage shall be 50.92 percent. Flexibility is granted due to the unique conuitions related to this site: A. a variance was previously approved specifically to permit the building expansion as is now proposed. B. previously approved site grading to remove portions of this site from the flood plain of Plymouth Creek have been completed. C. the proposed development would meet the previous Shoreland requirements and would result in less impervious coverage within the 300 -foot Shoreland Overlay District than was anticipated by the 1986 approval. Specifically, the impervious coverage within the 300 -foot Shoreland Overlay District would be reduced from 47.7 percent to 29.85 percent with the Proof -of -Parking Plan and 20.59 percent without the Proof -of -Parking Plan. D. the building site was created under previous, less restrictive regulations. 3. Standard Conditions: A. Compliance with the City Engineer's Memorandum. 0 96080. Page 2 i B. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. C. Submission of the required Financial Guarantee and Site Performance Agreement for completion of site improvements within twelve months of the date of this Resolution. D. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. E. Compliance with the Ordinance regarding the location of fine hydrants, fire lanes, and fire lane signage. F. All standard Fire Division notes and details shall be added to the plans prior to issuance of building permits. G. Submission of fire flow calculations prior to issuance of building permits. H. The Post Indicator Valve and the Fire Department Connection shall be added to the plans prior to issuance of building permits. I. An 8 1/2 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. J. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. K. The Developer shall hold the City and its officers, employees, and agents harmless from claims made by itself and third parties for damages sustained or costs incurred resulting from plat approval and development. The Developer shall indemnify the City and its officers, employees, and agents for ail costs, damages or expenses which the City may pay or incur in consequence of such claims, including attorneys' fees. L. Any signage shall be in compliance with the MPUD for Northwest Business Campus. Adopted by the City Council on August 7, 1996. STATE OF MINNESOTA) COUNTY OF HENNEPIN) SS.
