FOR "ROCKFORD GLEN THIRD ADDITION" LOCATED AT THE SOUTEF.AST CORNER OF OLD ROCKFORD ROAD AND PEONY LANE (96086) (MPIiD 95-1) WHEREAS. The Rottlutd Company, Inc. has requested an MPUD Final PlanlPlat for Rockford Glen Third Addition located at the southeast corner of Old Rockford Road and Peony Lane; and WHEREAS, the legal description of the subject property is as follows: Oudot A and B. Rockford Glen Second Addition. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the MPUD Final Plan/Plat for The Rottlund Company, Inc. for Rockford Glen Third Addition, located at the sovibeast corner of Old Rockford Road and Peony Lane, and, FURTHER, that it should and hereby does approve the following to be met, prior to recording of, and related to said plat: 1. Final Plat approval is hereby granted for Rockford Glen Third Addition in accordance with the plans received by the City on June 7, 1996, except as amended by this resolution. 2. Payment of park dedication fees -in -lice: of dedication in accordance with the Dedication Policy in effect at the time of recording the Final Plat. 3. The developer shall install wetland monumentation delineating the wetland within each lot. ?he monument design shall be approved by the Community Development Department. 4. Approval of a Wetland Mitigation Plain, prior to the issuance of grading permits and filing of the Final Plat. 5. Development Standards for zero -lot line homes. A. 25 -foot front yard setback B. 10 -foot side yard setback to single family lot C. 15 -foot side yard setback to zero lot line buildings D. 4 -foot side yard setback to zero lot line • Resolution 96 - 392 Page 2 E. 25 -foot rear yard setback to single family lot line F. 15 -foot rear setback to zero lot line buildings G. 4 -foot rear yard setback to zero lot line H. 25 -foot setback to wetlands I. 73 percent maximum lot coverage 6. Standard Conditions: A. Compliance with the City Engineer's Memorandum. B. Removal of all hazardous trees from the property at the owner's expense. C. No building permit shall be issued until a contract has been awarded for sewer and water. D. Street names shall comply with the City Street Naming System. E. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. F. No building permits shall be issued until the Final Plat is filed and recorded with Hennepin County. G. Final Plat mylars shall refer to MPUD 95-1. H. Appropriate legal documents regarding Homeowners Association documents, covenants and restriction ns approved by the City Attorney shall be filed with the Final Plat. I. The Developer shall hold the City and its officers, employees, and agents harmless fro►n claims made by itself and third parties for damages sustained or costs incurred resulting from plat approval and development. The Developer shall indemnify the City and its officers, employees, and agents for all costs, damages, or expenses which the City may pay or incur in consequence of such claims, including attomoys' fees. J. Location and number of fire hydrarts and fire lane signs shall be approved by the Fire Division, K. Submission of a Site Improvement Performance Agreement prior to issuance of building permits. L. Submission and approval of fire flow calculations for each hydrant, prior to issuance of building permits. Adopted by the City Council o i July 24, 1996.
