HomeMy WebLinkAboutCity Council Resolution 1996-370� � CITY OF PLYMOUTH RESOLUTION % - 370 APPROVING RESIDENTIAL PLANNED UNIT DEVELOPMENT AMENDMENT AND CONDITIONAL USE PERMIT AMENDMENT FOR ROGER SCHLUESSEL FOR PROPERTY AT 11400 -39TH AVENUE NORTH (RPUD 75-2) (96074) WHEREAS, Roger Schhressel has requested an RPUD Amendment and Conditional Use Permit Amendment to allow construction of a garage addition that would be set back six feet from the east side lot line, where ten feet is required, for property located at 11400 -39th Avenue North; The property is more specifically described as follows: Lot 11, Block 1, Mission Ridge 3rd Addition, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; NOW, 'THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of Roger Schluessel for an RPUD Amendment and Conditional Use Permit Amendment for a garage addition at 11400 -39th Avenue North, subject to the following conditions: I. This RPUD Amendment and Conditional Use Permit Amendment allows the construction of an 8.5 -foot by 16.5 -foot addition that would be set back six feet from the east side lot line, where ten feet is the requirement, in accordance with the application and plans received by the City on May 9, 1996 and May 31, 1996, except as amended by this resolution. 2. The addition shall not encroach into the six-foot wide drainage and utility easement that runs along the east lot line. 3. Prior to issuance of a building permit, the applicant shall provide an as -built survey of the lot to ensure that the addition would not encroach the six-foot wide drainage and utility easement that runs along the east lot line. 4. Compliance with all applicable requirements of the City and State Building Codes. LJ Resolution 96- 370 , Page 2 S. No other amendments or variations am granted or implied.
