FOR "TYLER'S UPLAND ADDITION" LOCATED SOUTH OF STH AVENUE AND EAST OF VICKSBURG LANE (96035) WHEREAS, BohLand Development Inc. has requested Final Plat approval for Tyler's Upland Addition, a plat of ten (10) single family lots on a 5.5 -acre parcel bituated south of 5th Avenue and east of Vicksburg lane, generally located at 430 and 500 Vicksburg Lane North; and WHEREAS, the City staff has prepared a Development Contract covering the improvements related to said plat. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the Final Plat for Tyler's Upland Addition located south of 5th Avenue and east of Vicksburg Lane, FURTHER, that the Development Contract for said plat be approved, and that the Mayor and City Manager be authorized to execute the Development Contract on behalf of the City, and, FURTHER, that the following conditions be met prior to recording of, and related to said plat: 1. Final Plat approval is hereby granted for Tyler's Upland Addition in accordance with the plans received by the City on May 17, 1996, except as amended by this resolution. 2. Prior to filing the Final Mat with Hennepin County, the applicant must submit a financial guarantee to the City to ensure the removal of the existing home from the site. 3. Minimum setbacks shall be as required for the R-lA zoning district. 4. Compliance with the City's Tree Preservation Ordinance. 5. The developer shall install an eight -foot wide bituminous trail along the north side of Lot 10. The developer shall provide the City with an easement for this trail prior to filing the Final Plat. Resolution 96-353 , Page 2 6. Standard Conditions: A. Compliance with the City Engineer's Memorandum. B. Removal of all humdous tray from the property at the owner's expense. C. No building permits shall be issued until a contract has been awarded for sewer and water. D. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. E. No building permits shall be issued until the Final Plat is filed and recorded with Hennepin County. F. Submittal of required utility and drainage easement documents as approved by the City Engineer prior to filing the Final Plat. rs. The Developer shall hold the City and its officers. employees, and agents harmless from claims made by itself and third parties for damages sustained or costs incurred resulting from plat approval and development. The Developer shall indemnify the City and its officers, employees, and agents for all costs, damages, or expenses which the City may pay or incur in consequence of such claims, including attorneys' fees. H. Street names shall comply with the City Street Naming System. I. Payment of park dedication fees -in -lieu of dedication with appropriate cr:dits in an amount determined according to verified acreage and trail paving costs and according to the Dedication Policy in effect at the time of recording the Final Plat. J. Private drive access shall be restricted from Vicksburg Imre. K. No Variances are granted or implied. L. The Development Contract, as approved by the City Council, shall be fully executed prior to release of the Final Plat. Approved by th,a City Council on June 26, 1996.
