ANDFRSON CONSTRUCTION COMPANY FOR PROPERTY LOCATED WEST OF FERNBROOK LANE AT SCHMIDT LAKE ROAD (96057) WHEREAS, Marvin H. Anderson Construction Company has requested a Final Plat for Fernbrook Woods 3rd Addition located west of Fernbrook Lane and north of Schmidt Lake Road; and WHEREAS, the City staff has prepared a Development Contract covering the improvements to said related plat; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the Final Plat for Fernbrook Woods 3rd Addition located west of Fembrook Lane and north of Schmidt Lake Road, FURTHER, that the Development Contract for said plat be approved, and that the Mayor and City Manager be authorized to execute the Development Contract on behalf of the City, and, FURTHER, that the City Council approves that the following shall be met, prior to recording of, and related to said plat: 1. No building permits shall be issued for Lot 10, Block 1 Lots 6 and 7, Block 2 until Schmidt Lake Read is constructed and open for traffic. 2. Standard Conditions: A. Compliance with the City Engineer's Memorandum. B. Removal of all dead or dying trees from the property at the owner's expense. C. No building permits shall be issued until a contract has been awarded for the construction of municipal sewer and water. D. Payment of park dedication fees -in -lieu of dedication paid prior to recording the plat with Hennepin County. E. Street names shall comply with the City Street Naming System. F. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures in subdivisions adjacent to, or containing any open storm water drainage facility. G. No building permits to be issued until the Final Plat is filed and recorded with Hennepin County. H. Yard setbacks shall comply with the R-18 Section of the Zoning Ordinance. W 96057, Page 2 I. Private driveway access shall be Limited to internal public roads and shall be prohibited from Fernbrook Lane a:td Schmidt Lake Road. J. Any signage shall be in compliance with the Ordinance. K. A sign shall be placed in the development notifying potential home buyers that Schmidt Lake Road will be extended through the development. L. Submittal of required utility and drainage easements as approved by the City Engineer prior to filing the Final Plat. M. The Development Contract, as approved by the City Council, shall be fully executed prior to release of the Final Plat. N. Submittal of a Site Improvem,:nt Performance Agreement for the transition landscaping prior to issuance of wilding permits. Adopted by the City Council on June .".u, 1996.
