RESOLUTION :'b-349
APPROVING CONDITIONAL USE PERMIT AMENDMENT AND SITE PLAN
AMENDMENT FOR THE WESTWIND GROUP OF MN, INC., FOR PROPERTY
LOCATED AT 10000 ROCKFORD ROAD (96070)
WHEREAS, The Westwind Group of MN, Inc., has requested approval of a
Conditional Use Permit Amendment and Site Plan Amendment for a playroom addition
onto the existing Burger King Restaurant located at Lot 1, Block 1, Rockford Square
Addition, Hennepin County, Minnesota; and
WHEREAS, the Planning Commission has reviewed said request at a duly called
Public Hearing and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve
the request by The Westwind Group of MN, Inc., for a playroom addition onto this
Burger King Restaurant, subject to the following conditions:
1. The Conditional Use Permit Amendment and Site Plan Amendment allow a 930
square -foot playroom addition and related site changes, in accordance with the plans
received by the City on May 31, 1996, except as amended by this resolution.
2. The development shall comply with the handicap accessibility requirements.
Specifically, the walkway shall have a maximum slope of no greater than 1:20.
3. An solenoid valve will be required on the fire sprinkler/domestic water supply line,
as approved by the Fire Inspectur.
4. Standard Conditions:
a. Compliance with the Engineer's Memorandum.
b. Submission of required financial guarantee and Site Itnprovemen,
Performance Agreement for completion of this site improvement within
twelve months of the date of this resolution.
c. Compliance with the Ordinance regarding the location of fire hydrants
and fire lanes, and fire lane signage.
d. Compliance with City Codes regarding fire suppression systems.
e. An 8 1/2 x 11 inch "As Built" Fire Protection Plan" shall be submitted
prior to the release or reduction of any site improvement bonds per City
Policy.

L Submission of approved fire flow calculations prior to the issuance of
building permits.
g. The permit is subject to all applicable codes, regulations and ordinances,
and violation thereof shall be grounds for revocation.
b. Any subsequent phases or expansions are subject to required reviews and
approvals per Ordinance provisions.
