HomeMy WebLinkAboutCity Council Resolution 1996-347CITY OF PLYMOUTH RESOLUTION % - 347 APPROVING RESIDENTIAL PLANNED UNIT DEVELOPMENT PRELIMINARY PLAN/PLAT AND CONDITIONAL USE PERMIT FOR SCHERBER PARTNERSHIP PROPERTIES FOR PROPERTY LOCATED NORTH OF 39TH AVENUE AND WEST OF DUNKIRK LANE (RPUD 92-1) (96005) WHEREAS, Scherber Partnership Properties has requested a Residential Planned Unit Development Preliminary Plan/Plat and Conditional Use Permit for a 20.06 -acre site located north of 39th Avenue and west of Dunkirk Lane. The property is more specifically described as: That part of the Northeast 1/4 of the Southwest 1/4 of Section 17, Township 118, North Range 22, West of the 5th Principal Meridian, lying North of a line drawn from a point on the East line thereof distance 659 feet South of the Northeast corner thereof to a point on the West line thereof 651.7 feet South of the Northwest corner thereof and Outlot B, Holly Creek 4th Addition, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Scherber Partnership Properties for a Residential Planned Unit Development Preliminary Plan/Plat and Conditional Use Permit for the 20.06 -acre site located north of 39th Avenue and west of Dunkirk Lane, subject to the following conditions: 1. RPUD Preliminary Plan/Plat and Conditional Use Permit approval is hereby granted for Holly Creek 5th Addition in accordance with the plans received by the City on May 31, 1996, except as amended by this resolution. 2. Minimum lot size shall be 13,662 square feet. 3. Minimum setbacks shall be as required for the R -IB zoning. 4. Maximum lot coverage shall be 20 percent. 5. Compliance with Section 6, Subdivision C of the Zoning Ordinance (Wetland Protection Ordinance). Resolution 96- 347 , Page 2 6. Compliance with the Concept Plan requirements Wating to the alternative buffers. 7. The RPUD Final Plan/Plat application shall inclu&, final analysis of the buffer strip vegetation standards. 8. Compliance with the City's Tree Preservation Ordinance. 9. Prior to filing the Final Piat, the developer shall submit access easement documents for the shared driveway for Lots 3 and 4 of Block 2. 10. Submission of a revised grading plan with the Final Plan/Plat application, as approved by staff, that indicates a berm along the south boundary of the site. 11. Standard Conditions: A. Compliance with the City Engineer's Memorandum. B. Removal of all hazardous trees from the property at the owner's expense. C. No building permits shall be issued until a contract has been awarded for sewer and water. D. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. E. No building permits shall be issued until the Final Plat is filed and recorded with Hennepin County. F. Submittal of required utility and drainage easement documents as approved by the City Engineer prior to filing the Final Plat. G. The Developer shall hold the City and its officers, employees, and agens harmless from claims trade by itself and third parties for damages sustained or costs incurred resulting from plat approval and development. The Developer shall indemnify the City and its officers, employees, and agents for all costs, damages, or expenses which the City may pay or incur in consequence of such claims, including attorneys' fees. H. Street names shall comply with the City Street Naming System. 1. Payment of park dedication fees -in -lieu of dedication in accordance with the Dedication Policy in effect at the time of recording the Final Plat. J. Fire Flow calculations shall be approved by the Fire Division prior to issuance of building permits. K. Location and number of fire hydrants shall be approved by the Fire Division. L. Submission of the required Financial Guarantee and Site Performance Agreement for completion of site improvements within twelve months of the date of this resolution. M. Private drive access shall be restricted from Dunkirk Lane. N. Final Plat mylars shall refer to RPUD 92-1. Resolution 96- 347 *Page 3 O. Appropriate legal documents regarding Homeowners Association documents, covenun and restrictions as approved by the City Attorney shall be filed with the Final Plat.
