HomeMy WebLinkAboutCity Council Resolution 1996-341CITY OF PLYMOUTH RESOLUTION 96 - 341 APPROVING PRELIMINARY PLAT AND VARIANCES FOR RICHARD BLOOM FOR GOLFVIEW WOODS LOCATED AT 16440 OLD ROCKFORD ROAD (96056) WHEREAS, Richard Bloom has requested a Preliminary Plat and Variances for GoNew Woods, a plat of five (5) single family lots on a 4.9 -acre parcel located at 16440 Old Rockford Road; and, the property is more specifically desribed as; That part of the northwest quarter of the northeast quarter of Section 17, Township 118, Range 22 west of the 5th Principal Meridian, lying northerly of County Road No. 9, described as commencing at the southeast comer of said northwest quarter of northeast quarter; thence north along the east line of said northwest quarter of northeast quarter a distance of 795.77 feet; thence deflecting 91 degrees 08 minutes 40 seconds left along a line hereinafter called "Line A" a distance of 106.84 feet to the actual point of beginning, thence deflecting 54 degrees 51 minutes 20 seconds left a distance of 644.21 feet to the centerline of County Road No. 9; thence northwesterly along said centerline a distance of 276.38 feet; thence deflecting 47 degrees 25 minutes 38 seconds right a distance of 370.72 feet to a point on the westerly extension of "Line A" thence easterly along said "Line A" to the point of beginning. WHEREAS, the Planning Commission has reviewed the Preliminary Plat and Variances at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of Richard Bloom for a Preliminary Plat and Variances for Golfview Woods located at 16440 Old Rockford Road, subject to the following conditions: 1. Preliminary Plat approval is hereby granted for GolMew Woods in accordance with the plans received by the City on May 3, 1996, except as amended by this resolution. 2. Minimum setbacks shall be as required for the R-1 A zoning district. 3. A Variance is granted to the Subdivision Code to allow the 45th Avenue North cul-de- sac to extend 153 feet for a total length of 1,203 feet, based on the finding that a) it is not prudent to demolish a $204,000 house to create a through street when it is possible to protect health, safety and welfare by providing emergency access in its place, b) the Developer has agreed to provide emergency access according to all City standards and provide additional off-street parking to substitute for parking that will be marked for a fire lane. A Variance is granted to the Subdivision Code to allow a lot width of 92 feet for Lot 4, based on the finding that a) it will &How the Developer to make a reasonable use of the land, while not being injurious to other nearby property, b)requiring the Developer to meet the lot width standard would result in unnecessarily large lot sins, c) such larger lot sizes would be contrary to the City's adopted Livable Communities' density goal for new single housing and d) it allows the provision of a reasonable yard for the existing home on Lot 3. 5. Compliance with the City's Tree Preservation Ordinance. 6. Submittal of easement documents for the Fire Lane along the western lot line of Lot 3 prior to filing the Final Plat. 7. Filing of a deed restriction requiring the owner of Lot 3 to maintain the Fire Lane to City standards at all times, including maintaining clear passage, prior to to issuance of a Certificate of Occupancy for any of the new homes in the plat. 8. Construction of the Fire Lane in accordance with City requirements, placement of signs along its full length and installation of a chain at Old Rxkford Road preventing general use of the Fire Lane and construction of two additional parking places on Lot 3 prior to issuance of a Certificate of Occupancy for any of the new homes in the plat. 9. Wetland buffer monuments shall be installed on Lot 5 in accordance with Section 6, Subdivision C.7. of the Plymouth Zoning Ordinance and the City's installation specifications. 10. The four new homes shall be constructed according to the same covenants as adopted by Golfview Estates. 11. Standard Conditions: A. Compliance with the City Engineer's Memorandum. B. Removal of all hazardous trees from the property at the owner's expense. C. Removal of outbuildings on Lots 4 and 5 prior to issuance of any building permits. D. No building permits shall be issued until a contract has been awarded for sewer and water. E. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. F. No building permits shall be issued until the Final Plat is filed and recorded with Hennepin County, G. Submittal of required utility and drainage easement documents as approved by the City Engineer prior to filing the Final Plat. • Resolution 96- 341 , Page 3 H. The Developer shall hold the City and its officers, employees, and agents harmless from claims made by itself and third parties for damages sustained or costs incurred resulting from plat approval and development. The Developer shall indemnify the City and its officers, employees, and agents for all costs, damages, or expenses which the City may pay or incur in consequence of such claims, including attorneys' fees. I. Street names shall comply with the City Street Naming System. J. Payment of park dedication fees -in -lieu of dedication in accordance with the Dedication Policy in effect at the time of recording the Final Plat. K. Fire Flo,.v calculations shall be approved by the Fire Division prior to issuance of building permits. L. Submission of the required Financial Guarantee and Site Performance Agreement for completion of site improvements within twelve months of the date of this resolution. M. Private drive access shall be restricted from Old Rockford Road. N. The existing home on Lot 3 will be re -addressed off 45th Avenue North. 0. No Zoning Ordinance Variances are granted or implied.
