AUTHORIZING CONDEMNATION PROCEEDINGS

CITY PROJECT NO, 502
WHEREAS, the City of Plymouth has undertaken City Project No. 502; and
WHEREAS, in order to construct the improvements, certain permanent and temporary
easements are required; and
WHEREAS, the City Council finds it necessary, proper, and expedient in the interests
of the public health, convenience and general welfare of the citizens of the City of
Plymouth for the City to acquire said easements; and
WHEREAS, the City Council finds that the construction schedule for said public
project makes it necessary to acquire title to and possession of the easement interests
prior to the filing of the final report of the condemnation commissioners to be
appointed by the district court; and
WHEREAS, the use of Minn, stet. Sec, 117.042 (1988), so-called "Quick -Take"
statute, will enable the City to timely acquire the required lands,
NOW, THEREFORE, BE IT HEREL Y RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA. That the City Attorney is hereby
authorized to commence condemnation proceedings utilizing said "Quick -Take" statute
for City Project No. 502 for the following described easements within the following
described parcels;
The east 1/2 of the northeast 1/4 of Section 7, Township 118, Range 22,
Hennepin County, MN.
A permanent easement for public street and utility purposes over, under,
across, and through the east 17.0 feet of the west 50.0 feet of the south
850.0 feet of said east 1/2 of the northeast 1/4.

Together with a permanent easement for drainage, ponding, and utility
purposes over, under, across, and through the east 135.0 feet of the west
168.0 feet of the north 260.0 feet of the south 1250.0 feet of said east
1/2 of the northeast 114.

Together with a temporary easement for construction purposes over,
under, across, and through the east 25 feet of the west 75.0 feet of the
south 500.0 feet of said east 1/2 of the northeast 114.

Together with a temporary easement for construction purposes over,
under, across, and through the east 60.0 feet of the west 110.0 feet of
the north 350.0 feet of the south 850.0 feet of said east 1/2 of the
northeast 114.

Together with a temporary easement for construction purposes over,
under, across, and through the east 77.0 feet of the west 110.0 feet of
the north 200.0 feet of the south 1050.0 feet of said east 1/2 of the
northeast 1/4.

Together with a temporary easement for construction purposes over,
under, across, and through the east 30.0 fee, -.�0 the west 63.0 feet of the
north 350.0 feet of the south 1400.0 feet of said east 112 of the northeast
1/4.
The above described temporary easement shall terminate on December 31, 1997
or upon completion of construction, whichever occurs first.

Together with a temporary easement for construction purposes over,
under, and across the west 10 feet of the east 27.0 feet of the above
described Tract A.
The above described temporary easement shall terminate on December 31, 1997
or upon completion of construction, whichever occurs first.
That part of the northeast 1/4 of Section 18, Township 118, Range 22,
Hennepin County, MN described as beginning at a point on the easterly
line of Peony Lane, distant 909.07 feet southerly, measured along said
easterly line, from the southerly line of Rockford Road; thence easterly
at a right angle to said easterly line a distance of 104 feet; thence
southeasterly deflecting to the right 67 degrees 14 minutes 50 seconds a
distance of 380.63 feet; thence southwesterly deflecting to the right 67
degrees 14 minutes 38 seconds a distance of 126.85 feet to the
northeasterly line of State Highway No. 55; thence northerly along the
right-of-way lines of State Highway No. 55 and Peony Lane to the point
of beginning.

The above described temporary easement shall terminate on December
31, 1997 or upon completion of construction, whichever occurs first.
The north 1/2 of the southwest 1/4 of the northeast 1/4 of Section 18,
Township I IS, Range 22, Hennepin County, MN except road.
A permanent easement for street and utility purposes over, under,
across, and through the west 12 feet of the east 45 feet of said north 1/2
of the southwest 1/2 of the northeast 1/4.

A temporary easement for construction purposes over, under, across,
and through the west 13 feet of the east 58 feet of said north 1/2 of the
southwest 1/4 of the northeast 1/4.
The above described temporary easement shalt terminate on December
319 1997 or upon completion of construction, whichever occurs first.
Adopted by the City Council on June 19, 1996.
