HomeMy WebLinkAboutCity Council Resolution 1996-3190 CITY OF PLYMOUTH RESOLUTION %- 319 APPROVING MPUD PRELIMINARY PLAT, MPUD PRELIMINARY PLAN AMENDMENT, CONDITIONAL USE PERMIT, AND FINAL PLAN/PLAT FOR UNITED PROPERTIES CORPORATION FOR PROPERTY LCtCATED NORTHWEST OF 25TH AVENUE AND POLARIS LANE (96045) (MPUD 83-1) WHEREAS, United Properties Corporation has requested an MPUD Preliminary Plat, MPUD Preliminary Plan Amendment, Conditional Use Permit, and Final Plan/Plat for Parkefs Lake Corporate Center for property legally described as follows: Outlot A, Parkers Lake Corporate Center 6th Addition. WHEREAS, the Planning Commission has reviewed said request at a duly called :public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by United Properties Corporation for an MPUD Preliminary Plat, MPUD Preliminary Plan Amendment, Conditional Use Permit, and Final Plan/Plat for Parkers Lake Corporate Center, subject to the following conditions: 1. This approval permits the construction of a 112,000 square foot multi -tenant office/warehouse building on the northerly parcel, in accordance with the plans received by the City on April 24, 1996, except as amended by this resolution. 2. Any signage shall be In compliance with the MPUD for Parkers Lake Corporate Center. 3. All waste and waste containers shall be stored within the building or within approved trash and recycling enclosures. 4. PUD flexibility is granted to allow placement of the loading dock area within 300 feet of residentially zoned property. 5, PUD flexibility is granted to allow lot coverage in excess of 35 percent. 6. This resolution approves a Variance to the Fire Code requirement for a fire lane within 50 feet of all sides of Cie building. 7. Installation A 131 narking spaces hiltially, with a proof -of -parking plan for an additional 179 parking sl.=s. :7 • Resolution 96-319 , Page 2 8. Submission and approval of a revised landscape plan that includes five additional evergreen trees along the west lot line, prior to issuance of the building permit. 9. The developer shall provide a 30 -foot wide trail easement along the north lot line. The developer shall construct an eight -foot wide trail to City specifications within the easement, which connects to the existing trail to the east and the proposed trail to the west. The developer is responsible for providing grading, base preparation, and suitable ground cover at the developer's expense. The cost of paving the trail will be reimbursed by the City after proof of such cost is presented. 10. Prior to the issuance of building permits, the applicant shall submit revised plans that include or identify the following items: A. Dimensions of handicap parking stall size and access aisle size. B. Handicap parking for vans. C. Proof -of -parking plan showing 14 -foot wide drive aisles for one-way traffic and showing compliance with minimum parking stall size requirements. 11. Submission of a restrictive covenant establishing a 60 -foot wide "No Build Zone" around the building, prior to issuance of buildiag permits. 12. Standard Conditions: A. Compliance with the City Engineer's Memorandum. B. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. C. Submission of the required Financial Guarantee and Site Performance Agreement for completion of site improvements within twelve months of the date of this Resolution. D. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. E. Compliance with the Ordinance regarding the location of fire hydrants, fire lanes, fire lane signage, and inside virning radius for fire lanes. F. An 8 1/2 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. G. Submission and approval of fire flow calculations prior to the issuance of building permits. H. The permit is subject to all applicable codes, regulations and ordinances, and viola, 'on thereof shall be grounds for revocation. 1. Park dedication fees were previously satisfied. J. Submittal of trail easements prior to Issuance of building permits. K. The Developer shall hold the City and its officers, employees, and agents harmless from claims made by itself and third patties for damages sustained or costs incurred resulting from plat approval and development. The Developer F Resolution 96-319 , Page 3 shall indemnify the City and its officers, employees, and agents for all costs, damages or expenses which the City may pay or incur in consequence of such claims, including attorneys' fees. L. No building permits shall be issued until the Final Plat is filed and recorded with Hennepin County. M. Final Plat mylars shall refer to MPUD 83-1. N. Submittal of required utility and drainage easement documents as approved by the City Engineer prior to filing the Final Plat. 13. Truck traffic is prohibited to and from the four most westerly loading docks from the hours of 11:00 p.m. to 6:00 a.m. Adopted by the City Council on June S, 1996.
