HomeMy WebLinkAboutCity Council Resolution 1996-301• CITY OF PLYMOUTH RESOLUTION 96- 301 DENYING CONDITIONAL USE PERMIT FOR SCOTT RUDIN FOR PROPERTY LOCATED AT 17525 -26TH AVENUE NORTH (96047) WHEREAS, Scott Rudin has requested a Conditional Use Permit to &:.,)w a Home Occupation business involving the rental of canoes and related camping gear for property legally described as follows: Lot 3, Block 2, Candlelight Terrace Addition. WHEREAS, the Planning Commission has reviewed said request at a dull, called Public Hearing and recommends denial. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does deny the request by Scott Rudin for a Conditional Use Permit for a Home Occupation business involving the rental of canoes and related camping equipment with the finding that the use does not meet the Conditional Use Permit standards outlined in the Zoning Ordinance, as follows: 1. The proposed business operation is not in compliance with the Comprehensive Plan, which designates this property, and the surrounding properties, as LA -1 for single family residential use. 2. The proposed business operation would be detrimental to general public welfare, morals and comfort. 3. The proposed business operation be injurious to the use and enjoyment of other properties in the immediate vicinity. This type of business would produce noise perceptible beyond the lot lines, and would bring commercial traffic and business activity into the neighborhood. 4. The proposed business operation would require more than the maximum two additional parking spaces specified in the ordinance. 5. The proposed business operation would involve outside storage of commercial goods in the R-lA single family residential district, which is not permitted by the ordinance.
