RESOLUTION 96-300
APPROVING CONDITIONAL USE PERMIT AMENDMENT, SITE PLAN
AMENDMENT AND VARIANCE FOR JERRY W. SISK FOR PROPERTY
LOCATED AT 14430 28TH PLACE N (96055)
WHEREAS, Jerry W. Sisk has requested approval of a Conditional Use Pcrmit
Amendment, Site Plan Amendment and Variance for an addition to an existing Burger
King Restaurant located in Lot 1, Block 1, Circle Star Business Center 5th Addition,
Hennepin County, Minnesota; and
WHEREAS, the Planning Commission has reviewed said request at a duly called
Public Hearing and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve
the request by Jerry W. Sisk for an addition to an existing Burger King Restaurant,
subject to the following conditions:
1. The Conditional Use Permit Amendment and Site Plan Amendment approved are
for a 576 square -foot storage room addition and related site changes, in accordance
with the plans received by the City on April 12, 1996, except as amended by this
resolution,
2. The new asphalt walkway shall comply with the handicap accessibility
requirements. Specifically, the walkway shall have a maximum slope no greater
than 1:20.
3. A Variance is granted for a 4.5 square -foot directional sign to be located at the
entrance to the site based on the funding that the request meets the Variance
standards, Specifically, an identical Variance was granted in 1983 but was not
acted upon by the applicant. The conditions upon which the 1983 Variance was
granted have not changed.
4. A Variance is granted for an additional free standing sign based on the finding that
the request meets the Variance standards, Specifically, the Variance requested is
unique and are not applicable to other property and that the request would not be
detrimental or injurious to the public safety or surrounding property,
5, Standard Conditions:
a, Compliance with the Engineer's Memorandum.

b. Submission of required financial guarantee and Site Improvement
Performance Agreement for completion of this site improvement within
twelve months of the date of this resolution.
c. Compliance with the Ordinance regarding the location of fire hydrants
and fire lanes, and fire lane signage.
d. Compliance with City Codes regarding fire suppression systems.
e. The permit is subject to all applicable codes, regulations and ordinances,
and violation thereof shall be grounds for revocation.
L Any subsequent phases or expansions are subject to required reviews and
approvals per Ordinance provisions.
g. Compliance with the Ordinance regarding outside lighting.
