HomeMy WebLinkAboutCity Council Resolution 1996-299CITY OF PLYMOUTH RESOLUTION %. 299 APPROVING PRELIMINARY PLAT AND VARIANCE FOR FAZENDIN BROTHERS INC. FOR "EVERGREEN KNOLL ADDITION" LOCATED SOUTH OF COUNTY ROAD 6 AND WEST OF URBANDALE LANE (96041) WHEREAS, Fazendin Brothers Inc. has requested a Preliminary Plat for Evergreen Knoll Addition, a plat of seven (7) single family lots on an approximately 5.2 -acre parcel situated south of County Road 6 and west of Urbandale Late; and WHEREAS, the Planning Commission has reviewed the Preliminary Plat at a duly called Public Hearing and recommends approval: NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of Fazendin Brothers Inc. for a Preliminary Plat for Evergreen Knoll Addition located south of County Road 6 and west of Urbandale Lane, subject to the following conditions: 1. Preliminary Plat approval is hereby granted for Evergreen Knoll Addition accordance with the plans received by the City on April 23, 1996, except amended by this resolution. in as 2. Minimum setbacks shall be as requited for the R -1A zoning district, including a 25 - foot setback from future 13th Avenue. 3. A Variance is granted to the Subdivision Code to allow a Minor Street grade of 7.5 percent. 4. The developer shall dedicate 54 feet of right-of-way from the centerline of County Road 6. 5. Compliance with the City's Tree Preservation Ordinance. 6. Standard Conditions: A. Compliance with the City Engineer's Memorandum. B. Removal of all hazardous trees from the property at the owner's expense. C. No building permits shall be issued until a contract has been awarded for sewer and water. D. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. Resolution 96- 299 , Page 2 E. No building permits shall be issued until the Final Plat is filed and recorded with Hennepin County. F. Submittal of required utility and drainage easement documents as approved by the City Engineer prior to filing the Final Plat. G. The Developer shall hold the City and its ofrwers, employees, and agents harmless from claims made by itself and third parties for damages sustained or coats incurred resulting from plat approval and development. The Developer shall indemnify the City and its officers, employees, and agents for all coats, damages, or expenses which the City may pay or incur in consequence of such claims, including attorneys' fees. H. Street names shall comply with the City Street Naming System. I. Payment of park dedication fees -in -lieu of dedication in accordance with the Dedication Policy in effect at the fire of recording the Final Plat. J. Fire Flow calculations shall be approved by the Fire Division prior to issuance of building permits. K. Submission of the required Financial Guarantee and Site Performance Agreement for completion of site improvements within twelve months of the date of this resolution. L. Private drive access shall be restricted from County Road 6. M. No Zoning Ordinance Variances are granted or implied. Approved by the City Council on June 5, 1996.
