HomeMy WebLinkAboutCity Council Resolution 1996-296• CITY OF PLYMOUTH RESOLUTION % - 296 APPROVING SITE PLAN AND VARIANCE FOR TURCK, INC., FOR PROPERTY LOCATED AT THE NORTHEAST CORNER OF SCHMIDT LAKE ROAD AND FERNBROOK LANE. (96040) WHEREAS, TURCK Inc. has requested Site Plan approval and a Variance to allow construction and operation of an industrial building on property legally described on the attached Exhibit " A"; and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by TURCK Inc. for Site Plan approval and a Variance, subject to the following conditions: 1. The Site Plan approval is for a 77,378 square foot industrial building, according to the plans received by the City on April 11, 1996, except as amended by this resolution. 2. The site plan is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. 3. An eight -foot tall fence, 60 feet in length, shall be placed on the west side of the truck loading area. The fence in combination with the two -foot lower grade of the truck loading area shall provide the required screening of the loading area from the residential property west of this site. The eight evergreen trees in this location may be removed if they are relocated elsewhere on the site. A revised Site Plan shall be submitted to the Planning Division prior to issuance of building permits. 4. The plans shall be revised to include a berm on the west side of the parking lot that would be at least four -feet higher than the elevation of the parking lot. A revised Grading Plan shall be submitted to the Planning Division prior to issuance of building permits. 5. The plans shall be revised to include eight, six-foot evergreen trees located on the west side of the parking lot. A revised Landscaping Plan shall be submitted to the Planr,, •q Division prior to issuance of building permits. 6. Compliance with State and Federal requirements for handicapped parking requirements. • 96040, Page 2 7. Trash and recycling facilities shall be located in the enclosed container identified on the plans. 8. Impervious coverage shall be 35 percent. A Variance is granted due to the unique conditions related to this site: A. the preliminary plat was created under -, :vious, less restrictive regulations B. the proposed development would meet the previous Shoreland requirements and would result in zero percent impervious coverage within the 300 -foot Shoreland Overlay District. C. the Variance would not be detrimental to the public welfare or injurious to other land. 9. Wetland buffer monuments shall be installed in accordance with Section 6, Subdivision C.7. of the Plymouth Zoning Ordinance and the City's installation specifications. 10. A deed shall be recorded on the property requiring the property owner to pay for the closing of the median curb cut on Fernbrook Lane when the street is extended north of the Soo Line Railroad. The deed shall be submitted prior to recording the Lot Division. 11. Standard Conditions: A. Compliance with the City Engineer's Memorandum. B. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. C. Submission of required Financial Guarantee and Site Performance Agreement for completion of site improvements within twelve months of the date of this resolution. D. Any signage shall be in compliance with the Ordinance. E. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. F. Compliance with all Fire Codes and policies, including these regarding the location of fire hydrants and fire department connection, fire lanes, and fire lane signage. G. An 8 1/2 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. H. Submission and approval of fire flow calculations prior to the issuance of building permits. I. The diameter of piping required for domestic and irrigation water supply shall be no more than 'A the diameter of the building water service. Parcel A: All that part of Lot 1, Block 1, Plymouth Technology Park, according to the plat thereof on file and of record in the office of the Registrar of Titles, Hennepin County, Minwsota, which lies westerly, northerly and westerly of the following described line: Commencing at the southeast corner of said Lot 1; thc"ce on an assumed bearing of south 89 degrees 58 minutes 47 seconds west along the southerly litre of said Lot 1 for 471.11 feet to the actual point of beginning of the line to be described; thence north 00 degrees 01 minutes 13 seconds west for 638.07 feet; thence north 89 degrees 58 minutes 47 seconds east for 245.00 feet; thence north 00 degrees 01 minutes 13 seconds west for 330.50 feet to the northerly line of said Lot 1 and there terminating.
