HomeMy WebLinkAboutCity Council Resolution 1996-289• CITY OF PLYMOUTH RESOLUTION NO. 96 - 289 AUTHORIZING THE VACATION OF PART OF 53RD AVENUE STREET RIGHT-OF-WAY WHEREAS, a petition was received to vacate part of 53rd Avenue Right -of -Way; and WHEREAS, said petition was signed by a majority of the owners of the land abutting the area proposed to be vacated; and WHEREAS, a public hearing with respect to said vacation was scheduled for May 159 1996 in accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of May 15, 1996; and WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and WHEREAS, the Council did hold a public hearing on May 15, 1996 to inform any and all interested parties relevant to the vacation of a part of 53rd Avenue Right -of -Way; and WHEREAS, it was determined by the City Council that said easements were not needed for public purposes; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the following part of 53rd Avenue Right -of - Way be vacated: That part of 53rd Avenue North as dedicated in Pheasant Trail, according to the recorded plat thereof, Hennepin County, Minnesota, lying northerly and southerly of a 50.00 foot strip of land and the centerline of said strip as described Beginning at the intersection of the centerline of said 53rd Avenue North with the southwesterly extension of the southeasi%.rly line of Lot 2, Block 1, said Pheasant Trail, for the purpose of this description of the southeasterly line of said Lot 2 has an assumed bearing of south 36 degrees 30 minutes 48 seconds west; thence southeasterly and northeasterly 72.67 feet along a nontangential curve, concave to the north, having a radius of 68.04 feet and a central angle of 61 degrees 11 minutes 26 seconds, the chord of said curve beats south 84 degrees 04 minutes 46 seconds east; thence northeasterly 36.25 feet to th, centerline of Union Terrace Lane North as platted in the The Ponds tit Bass Creek 2nd Addition, according to the recorded plat thereof, and said centerline there terminating, O;ZNOIVACA?IOMAIML\AU NORMWhV5.DOC RESOLUTION NO. % - Pap Two FURTHER, that said vacation shall not affect the authority of any person, corporation, or municipality owning or controlling the electric or telephone poles and lines, gas and sewer lines,water pipes, mains and hydrants thereon or thereunder, to continue maintaining the same, to enter upon such way or portion thereof vacated to repaid, replace, remove otherwise attend thereof.
