HomeMy WebLinkAboutCity Council Resolution 1996-284CITY OF PLYMOUTH RESOLUTION % -284 APPROVING PRELIMINARY PLAT FOR BOHLAND DEVELOPMENT FOR "TYLER'S UPLAND ADDITION" LOCATED SOUTH OF 5TH AVENUE AND EAST OF VICKSBURG LANE (96035) WHEREAS, BohlAW Development has requested a Preliminary for Tyler's Upland Addition, a plat of ten (10) single family lots on a 5.5 -acre parcel situated south of 5th Avenue and east of Vicksburg Lane, generally located at 430 and 500 Vicksburg Lane North; and WHEREAS, the Planning Commission has reviewed the Preliminary Plat at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of BohL and Development for a Preliminary Plat for Tyler's Upland Addition located south of 5th Avenue and east of Vicksburg Lane, subject to the following conditions: 1. Preliminary Plat approval is hereby granted for Tyler's Upland Addition in accordance with the plans received by the City on April 2, 1996, except as amended by this resolution. 2. Prior to filing the Final Plat with Hennepin County, the applicant must submit a financial guarantee to the City to ensure the removal of the existing home from the site. 3. Minimum setbacks shall be as required for the R-lA zoning district. 4. Compliance with the City's Tree Preservation Ordinance. 5. The developer shall install an eight -foot wide bituminous trail along the north side of Lot 10. The developer shall provide the City with an easement for this trail. 6. Standard Conditions: A. Compliance with the City Engineer's Memorandum, except Item # 25A relating to the requirement for a turnaround for 5th Avenue. B. Removal of all hazardous trees front the property at the owner's expense. C. No buildiug permits shall be issued until a contract has been awarded for Resolution 96- 284 , Page 2 sewer and water. D. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. E. No building permits shall be issued until the Final Plat is filed and recorded with Hennepin County. F. Submittal of required utility and drainage easement documents as approved by the City Engineer prior to filing the Final Plat. G. The Developer shall hold the City and its officers, employees, and agents harmless from claims made by itself and third parties for damages sustained or costs incurred resulting from plat approval and development. The Developer shall indemnify the City and its officers, employees, and agents for all costs, damages, or expenses which the City may pay or incur in consequence of such claims, including attorneys' fees. H. Street names shall comply with the City Street Naming System. I. Payment of park dedication fees -in -lieu of dedication in accordance with the Dedication Policy in effect at the time of recording the Final Plat. J. Fire Flow calculations shall be approved by the Fire Division prior to issuance of building permits. K. Submission of the required Financial Guarantee and Site Performance Agreement for completion of site improvements within twelve months of the date of this resolution. L. Private drive access shall be restricted from Vicksburg Lane. M. No Variances are granted or implied. Approved by the City Council on May 15, 1996.
