RESOLUTION 96 - 265
APPROVING A MPUD PRELIMINARY PLAN/PLAT, FINAL PLAN/PLAT AND
CONDMONAL USE PERMIT ; OR CARLSON REAL ESTATE CO. FOR
PROPERTY LOCATED AT THE SOUTHWEST CORNER OF I494 AND
CARLSON PARKWAY (96004)
WHEREAS, Carlson Real 'Estate Co. has requested approval of a MPUD Preliminary
PlaNPIat, Final Plat,: Plat and Conditional Use Permit for property more specifically
described as follows:
Lots 1 and 2, Block I. Carlson Center 15th Addition, Hennepin County,
Minnesota.
WHEREAS, the Planning Commission has reviewed said request at a duly called
Public Hcaring and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve
the request of Carlson Real Estate Co. for a MPUD Preliminary Plan/Plitt, Final
Plan/Plat and Conditional Use Permit for property located at the southwest corner of I-
494 and Carlson Parkway, subject to the following conditions:
1. The &1PTJD Preliminary Plan is for two 80,000 square -foot office buildings in the
Carlson Center 15th Addition in accordance with the plans received by the City on
March 14, 1996 except az amended by this r --solution.
2. The MPUD Preliminary Plat and Final Plat are for the creation of two lots in the
Carlson Center 15th Addition.
3. A Conditional Use Petmit is approved for Lot 2, Plock 1 Carslon Center 15th.
Addition to permit a maximum building height of five stories (70 feet).
4. A MPUD Final Plan is approved for the construction of a four-story, 80,000
square -foot office building on Lot 1, Block 1 Carlson Center 15th Addition in
accordance with the plans received by the City on March la, 1996 except as
amended by this resolution.
5. Covenants regarding cross access and parking shall be submitted for staff review
and shall be filed with Hennepin County prior to issuance of building permits.
6. The developer shall repair any damage to the sidewalk along Carlson Parkway that
may occur during construction of this project.
7. A Variance form the Fire Code is granted from the fire lane requirement on the
south side of the building on Lot 1 and the east side of the building on Lot 2.

8. All signage shall comply with the sign package submitted with the plans dated
March 14, 1996.
9. Standard Conditions:
A. Compliance with the City Engineer's Memorandum.
B. Compliance with Policy Resolution 79-80 regarding minimum floor
elevations for new structures on sites adjacent to, or containing any open
storm water drainage facility.
C. Submission of the required Financial Guarantee and Site Performance
Agreement for completion of site improvements. Completion of
improvements for Lot 1 shall be within twl-lve months of the date of this

D. Any subsequent phases or expansions are subject to required reviews and
approvals per Ordinance provisions.
E. Compliance with the Ordinance regarding the location of fire hydrants,
fire lanes, and fire lane signage except as amended by this Resolution.
F. An 8 1/2 x 11 inch "As Built" Fire Protection Plan shall be submitted
prior to the release or reduction of any site improvement bonds per City
Policy.
G. Submission and approval of fire flow calculations prior to the issuance of
building permits.
H. The permit is subject to all applicable codes, regulations and ordinances,
and violation thereof shall be grounds for revocation.
I. Park dedication fees shall be cash fees in lieu of land dedication in
accordance with the dedication policy in effect at the time of building
permit issuance.
J. The Developer shall hold the City and its officers, employees, and
agents harmless from claims made by itself and third parties for damages
sustained or costs incurred resulting from plat approval and
development. The Developer shall indemnify the City and its officers,
employees, and agents for all costs, damages or expenses which •he City
may pay or incur in consequence of such claims, including attorneys'
fees.
K. No building permits shall be issued until the Final Plat is riled and
recorded with Hennepin County.
L. No building permits shail be issued until a contract has been awarded for
construction of municipal sewer and water.
tii. All trach, waste and recycling facilities shall be stored withil the
buildings as identified on the plans.
