HomeMy WebLinkAboutCity Council Resolution 1996-262L3 CITY OF PLYMOUTH RESOLUTION 96- 262 APPROVING MIXED PLANNED UNIT DEVELOPMENT FINAL PLAN/PLAT AND DEVELOPMENT CGNTRACT FOR HARSTAD HOMES, INC. FOR "SUGAR HILLS 4TH ADDITION" LOCATED SOUTHWEST OF VICKSBURG LANE AND NEW COUNTY ROAD 9 (MPUD 92-1) (95090) WHEREAS, Harstad Homes, Inc. has requested approval of an MPUD Final P1an\Plat for the development of approximately nine acres situated southeast of Vicksburg Lane and new County Road 9, legally described as Outlot G and Outlot M, Sugar Hills Addition, and WHEREAS, the City staff has prepared a Development Contract covering the improvements related to said plat. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of Harstad Homes, Inc. for an Final Plan/Plat for Sugar Hills 4th Addition, and, FURTHER, that the Development Contract for said plat be approved, and that the Mayor and City Manager be authorized to execute the Development Contract on behalf of the City, and, FURTHER, that the following conditions be met prior to filing of the said Plat: 1. Final Plat approval is hereby granted for Sugar Hills 4th Addition in accordance with the plans received by the City on March 29, 1996, except as amended by this resolution. 2. Development Standards shall be as follows: A. 25 -foot front yard setback from street right-of-way B. 20 -foot setback between buildings C. 50 -foot setback to Vicksburg Lane and County Road 9 D. 15 -foot setback to single fa►,.ily platted lots 3. The individual unit driveways must be at least 22 feet long between the front of the garage and the private driveway. 4. Homeowner's Association documents shall require ownership and maintenance of Outlot A, including the fence. Resolution 96- 262 , Page 2 of 3 5. Homeowner's Association documents shall require ownership and maintenance of the private driveway. 6. Compliance with the City's Tree Preservation Policy. 7. Payment of park dedication fees -in -lieu of dedication in accordance with the Dedication Policy in effect at the time of recording the Final Plat. 8. The developer shall not use the existing trail for access or storage. Any damage done to the trail must be repaired at the developer's expense. 9. The developer shall provide copies of the current overall PUD Plan and its current conditions as an addendum to their purchase agreement. 10. The private driveway shall be a fine lane and shall be marked with appropriate signage. 11. The entrance to the driveway leading off the end of the cul-de-sac shall be marked with signage indicating that the driveway is private. 12. Each individual survey for homes abutting Vicksburg Lane and County Road 9 shall include the 50 -foot setback line from those rights-of-way. 13. Standard Conditions: A. Compliance with the City Engineer's Memorandum, B. Removal of all hazardous trees from the property at the owner's expense. C. No building permits shall be issued until a contract has been awarded for sewer and water. D. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. E. No building permits shall be issued until the Final Plat is filed and recorded with Hennepin County. F. Submittal of required utility and drainag: easement documents as approved by the City Engineer prior to filing the Final Plat. G. The Developer shall hold the City and its officers, employees, and agents harmless from claims made by itself and third parties for damages sustained or costs incurred resulting from plat approval and development. The Developer shall indemnify the City and .ts officers, employees, and agents for all costs, damages, or expenses whit h the City tnay pay or incur in consequence of such claims, including attorneys' fees. K. Street names shall comply with the City Street Naming System. I. Subsequent phases shall be subject to ordinance provisions for plan and plat Resolution 96- 262 , Page 3 of 3 application for the review and approval. J.. Submittal of the trail easements prior to recording the Final Plat. K. Final Plat mylars shall refer to MPUD 92-1. L. Appropriate legal documents regarding Homeowners Association documents, covenants and restriction as approved by the City Attorney shall be filed with the Final Plat. M. Location and number of fire hydrants and fire lane signage shall be approved by the Fire Division. N. Fire Flow calculations shall be approved by the Fire Division prior to issuance of building permits. 0. Any signage shall comply with the Sign Ordinance. P. Submission of the required Financial Guarantee and Site Performance Agreement for completion of site improvements within twelve months of the date of this resolution. Q. Private driveway access shall be restricted from Vicksburg Lane and County Road 9. R. The Development Contract, as approved the City Council, shall be fully executed prior to release of the Final Plat. Approved by the City Council on May 15, 1996.
