HomeMy WebLinkAboutCity Council Resolution 1996-255CITY OF PLYMOUTH RESO".UTION NO. % -255 DECLARING PROPERTY SURPLUS AND AUTHORIZING ITS CONVEYANCE TO ADJOINING PROPERTY OWNER CITY PROJECT NO. 330 WHEREAS, the reconstruction of West Medicine Lake Drive to accommodate the West Medicine LAke Park required the acquisition of a portion of the frontage of the property of Mr. Gary Charboneau; and WHEREAS, a portion of the adjoining lot to Mr. Charboneau will be severed by the new West Medicine Lake Drive; and WHEREAS, Mr. Charboneau has agreed to accept "That part of Lot 4, Block 1, Penwalk Addition, Hennepin County, Minnesota described as follows: Beginning at the northwest corner of said Lot 4, Block 1, Penwalk Addition; thence easterly along the north line thereof a distance of 1C7.53 feet; thence deflecting right 85 degrees, 00 minutes 00 seconds a distance of 12.70 feet; thence southwesterly to a point on the westerly line of said Lot 4 distant 28.00 feet southeasterly from the northwest corner thereof, thence northwesterly to the point of beginning and there terminating," as compensation for the easterly portion of his original lot needed by the City for additional roadway. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: As Pillows: 1. That the above described property is hereby declared surplus property. 2. That exchanging the above described property as compensation for easements needed is considered a public purpose. 3. That the Mayor and City Manager are hereby authorized to convey the surplus property to Gary W. Charboneau, the immediate adjacent property owner in exchange for the new easements.
