HomeMy WebLinkAboutCity Council Resolution 1996-242a CITY OF PLYMOUTH RESOLUTION 96 - 242 APPROVING FINAL PLAT, SITE PLAN AND CONDITIONAL USE PERMIT FOR RYAN CONSTRUCTION COMPANY, INC. FOR PROPERTY LOCATED SOUTH OF FIRST AVENUE AND WEST OF XEMUM LANE (96028) WHEREAS, Ryan Construction Company, Inc. has requested approval of a Final Plat, Site Plan and Conditional Use Permit for Novus Marketing for property legally described as Oudot A, Carlson Center 11th Addition; and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Ryan Construction Company, Inc. for a Final Plat, Site Plan and Conditional Use Permit for Novus Marketing, subject to the following conditions: 1. This approval is for the creation of one lot and permits the construction of a 24,304 square foot office building, in accordance with the plans received by the City on March 18, 1996, except as amended by this resolution. 2, The Conditional Use Permit approves a building with 100 percent office use in the I-1 district. 3. Payment of park dedication fees -in -lieu of dedication in accordance with the Dedication Policy in effect at the time of building permit issuance, prior to the issuance of building permits. 4. All waste and waste containers shall be stored within the building, and no outside storage is permitted. S. A proof -of -parking plan is approved vor the required loading berth (truck parking space). If the City requires such loading berth to be installed at any time in the future, the loading l girth must comply with all screening requirements from the residential property to the south. 6. Approval by the Minnehaha Creek Drainage District prior to issuAnce of building permits. 7. Prior to the issuance of building permits, all plan sheets must be signed. a • Resolution 96- 242 , Page 2 8. Prior to the issuance of building permits, the applicant shall submit revised a utility plan that indicates the location of the fire department connection and indicates if the utility system is or will be looped. 9. Prior to issuance of building permits, the applicant shall submit a wetlands report for this site. 10. The City will be constructing a trail in the right-of-way along the west side of Xenium Lane. The developer shall not hinder the construction of, or damage this trial, in the course of their construction. 11. Standard Conditions: A. Compliance with the City Engineer's Memorandum. B. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. C. Submission of the required Financial Guarantee and Site Performance Agreement for completion of site improvements within twelve months of the date of this Resolution. D. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. E. Compliance with the Ordinance regarding the location of fire hydrants, fire lanes, and fire lane signage. F. An 8 112 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. G. Sucmission and approval of fire flow calculations prior to the issuanix of bu:ldittg permits. H. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. I. Compliance with the sign ordinance.
