HomeMy WebLinkAboutCity Council Resolution 1996-241s CITY OF PLYMOUTH RESOLUTION % - 241 APPROVING SITE PLAN, CONDITIONAL USE PERMIT, AND VARIANCE FOR ROGER'S BODY SHOP FOR PROPERTY LOCATED SOUTHEAST OF THE INTERSECTION OF EMPIRE LANE AND HARBOR LANE (96027) WHEREAS, Roger' Body Shop has requested approval of a Site Plan, Conditional Use Permit, and Variance for an auto body repair shop for property located southeast of the intersection of Empire Lane and Harbor Lane; more specifically described as: Lot 2, Block 1, Elwell Miley and Quinn Addition. WHEREAS, the Planning Commission has considered the request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the Site Plan, Conditional Use Permit, and Variance for an auto body repair shop with a vehicle storage lot for property located southeast of the intersection of Empire Lane and Harbor Lane, subject to the following conditions: 1. The Site Plan and Conditional Use Permit approval allows the construction of a 29,680 square foot auto body repair shop, in accordance with the plans received by the City on March 19, 1996, except as amended by this resolution. 2. A Conditional Use Permit is approved to allow outside storage of automobiles in the screened vehicle storage lot located on the east side of the building. No other outside storage is approved by this resolution. 3. A Variance is approved to allow a ten -foot parking lot setback from the east lot line. 4. Prior to the issuance of boding permits, the applicant shall submit revised plans that include or identify the Iollowing items: A. Compliance, with the Ordinance provision pertaining to materials used for the refuse/recycling enclosure. B. Setback dimension between the parking lot and the east lot line. C. 1:20 access for the Handicap parking space on the north side of the building. D. Dimensions of Handicap parking spaces, pursuant to State Code. E, Lighting plan showing that .5 foot-candle will not cross the lot lines. t'. Relocation of the southwest hydrant to a location as approved by the Fire Inspector. G, 1 112 inch maximum domesticlirrigation off a six inch water line. 0 • Resolution 96 - 241 , Page 2 of 2 H. Fire lane hatching extended to the public street. S. Prior to is�liance of building permits, cross -easements as approved by the City shall be filed with Hennepin County. The easements shall address the south curb cut/drive aisle, fencing, and water quality pond where they cross lot lines. 6. Standard Conditions: A. Compliance with the City Engineer's Memorandum. B. Payment of park dedication fees -in -lieu of dedication in accordance with the Dedication Policy in effect at the time of building permit issuance. C. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. D. Submission of required Financial Guarantee and Site Performance Agreement for completion of site improvements within 12 months of the date of this resolution. E. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. F. Compliance with the Ordinance regarding the location of fire hydrants, fire lanes, and fire lane signage. 0. An 8 1/2 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. H.
