APPROVING RPUD FINAL PLAN/PLAT AND DEVELOPMENT CONTRACT FOR
LUNDGREN BROTHERS CONSTRUCTION INC. LOCATED AT THE NORTHWEST
QUADRANT OF PEONY LANE AND OLD ROCKFORD ROAD (94162F)
WHEREAS, Lundgren Bros. Construction Inc. hes requested approval of a Residential
Planned Unit Development Final Plan/Plat for the development of approximately 71.78
acres located at the northwest quadrant of Peony Lane and Old Rockford Road; and,
WHEREAS, the City scoff has prepared a Development Contract covering the
improvements related to said plat;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the Final
Plan/Plat and Development Contract for Plum Tree for property located at the northwest
quadrant of Peony Lane and Old Rockford Road: and,
FURTHER, that the Development Contract for said plat be approved, and that the Mayor
and City Manager be authorized to execute the Development Contract on behalf of the
City; and,
FURTHER, that the fallowing conditions be met prior to recording of, and related to said
Flat:
1. This Final Plan/Plat approval in for the creation of 33 lots and four outlots in the Plurd
Tree subdivision.
2. Approval of a Wetland Mitigation Plan prior to the issuance of grading permits.
3. Scmning along County Road 9 (Old Rockford Road) and Peony Lane shall be
provided in accordance with the approved Landscape Plan.
4. Maximum lot coverage shall be 25 percent.
5. Perimeter monuments shall be in conformance with the approved RPUD Preliminary
Plan.
6. Prior to issuance of building permits, buffer monuments shall be placed in accordance
with Section 6, Subdivision C.7 of tiic Zoning Ordinance.

7. The RPUD End plat shall not be recorded prior to the awarding of the contract for
the trunk sanitary sewer and the development contract will provide that the
developer shall hold the City harmless should the contract not be awarded.
8. The contract for Peony Lane shall be awarded prior to submission of a RPUD rind
Plat for any portion of the project requiring access form Peony Lane.
9. The contract for the trunk sanitary sewer shall be awarded prior to construction
beginning on the interior sanitary sewer.
10. A 28 -foot back to back street width design is approved for use in this subdivision
with the exception of Urbandale Lane from Old Rockford Rd. to 46th. Ave. N.
The requited street width for Queensland Lane from Peony Lane to 46th Ave. N.
shall be determined when the right-of-way for Queensland Lane is platted.
11. A six-foot concrete sidewalk shall be constructed by the developer as shown on the
street construction plans received by the City on March 20, 1996. The sidewalks
shall be located on the east side of Urbandale Lane N. originating at Old Rockford
Road and on the north side of 46th Ave. N.
12. Development Standards:
A. 25 -foot front yard setback
B. 6 -foot side yard setback to garages
C. 9400t side yard setback to living space
D. 20 -foot rear yard setback
E. 50 -foot setback to Peony Lane Right of Way
F. 25 -foot wetland rear yard setback
G. 10 -foot wetland side yard setback
H. 10 -foot average buffer
12. Disclosure documents for this development shall include specific reference to the
Soo Line Railroad tracks and the Peony Lane bridge over the railroad.
13. Standard Conditions:
A. Compliance with City Engineer's Memorandum.
B. Removal of all hazardous trees from the property at the owner's
expense.
C. No building permit shall be issued until a contract has been awarded for
sewer and water.
D. Street names shall comply with the City Street Naming System.
E. Compliance with Policy Resolution 79-80 regarding minimum floor
elevations for new structures on sites adjacent to, or containing any open
storni water drainage facility.

F. No building permits shall be issued until the Final Plat is filed and
recorded with Hennepin County.
G. Private driveway access shall be limited to internal public roads and
restricted from County Road 9 (Old Rockford Rd.) am, Peot>)+ Lane.
H. Final Plat mylars shall refer to RPUD 95-1.
I. Location and member of fire hydrants shall be approves! by the Fire
Division.
J. Submission of a Site Improvement Performance Agreement prior to
issuance of building permits for common landscaping recreational
features and buffer nimmnentation.
K. Appropriate legal documents regarding Homeowners Association
documents, covenants and restriction as approved by the City Attorney
shall be filed with the Final Plat. Specific reference shall be made to the
maintenance of the active recreational features, common landscaping, the
landscaping in street islands and all sidewalks or trails.
L. The Developer shall hold the City and its officers, employees, and
agents harmless from claims made by itself and third parties for damages
sustained or costs incurred resulting from plat approval and
development. The Developer shall indemnify the City and its officers,
employees, and agents for all costs, damages, or expenses which the
City may pay or incur in consequence of such claims, including
attorneys' fees.
M. Submittal of required utility and drainage casements as approved by the
City Engineer prior to filing the Final Plat.
N. Compliance with the terms of City Council Resolution 89-439 regarding
tree preservation.
0. The Development Contract, as approved by the City Council, shall be
fully executed prior to release of the Final Plat.
