HomeMy WebLinkAboutCity Council Resolution 1996-213CITY OF PLYMOUTH RESOLUTION 96. 213 APPROVING CONDITIONAL USE PERMIT AMENDMENT AND SITE PLAN AMENDMENT FOR ASCENSION EVANGELICAL LUTHERAN CHURCH FOR PROPERTY LOCATED AT 15870 -46TH AVENUE NORTH (96018) WHEREAS, John A. Hinnenthal has requested approval of a Conditional Use Permit Amendment and Site Plan Amendment to allow an addition to Ascension Evangelical Lutheran Church, 15870 -46th Avenue North (the property is more specifically described as Lot 1, Block I, Amhurst 6th Addition); and WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by John A. Hinnenthal for a Conditional Use Permit Amendment and Site Plan Amendment to allow an addition to Ascension Evangelical Lutheran Church, 15870 -46th Avenue North, subject to the following conditions: 1. The Amended Conditional Use Permit and Site Plan allows construction of a 3,570 square foot addition, in accordance with the plans received by the City on March 41 1996, except as amended by this resolution. 2. Submission and approval of fire flow calculations, prior to issuance of building permits. 3. Submission and approval of a utility plan that identifles the size and location of the water supply, prior to issuance of building permits. 4. This resolution approves a Variance to the Fire Code requirement for a fire lane within 50 feet of all sides of the building. 5. Signage identifying Handicap parking spaces must meet the State Handicap Code. 6. Standard Conditions: a. Compliance with the Engineer's Memorandum. b. Subn.[salon of required financial guarantee and Site Improvement Performance Agrccment for completion of this site improvement within twelve months of the date of this msolution. • Resolution 96- 213 , Page 2 c. Compliance with the Ordinance regarding the location of fire hydrants and fire lanes, and fire lane signage. d. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. e. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. f. Submission of an 8 1/2 by 11 inch "as -built" Fire Protection Plan prior to the release or reduction of the required financial guarantee. Adopted by the City Council on April 17, 1996.
