HomeMy WebLinkAboutCity Council Resolution 1996-204• CITY OF PLYMOUTH RESOLUTION NO. % - 204 AUTHORIZING THE VACATION OF A SEWER EASEMENT AS REFERRED IN DOCUMENT NO. 851%2 WHEREAS, a petition was received to vacate a sewer easement in the northwest 1/4 of the southwest 1/4 of Section 26, Township 118, Range 22; and WHEREAS, said petition was signed by a majority of the owners of the land abutting the area proposed to be vacated; and WHEREAS, a public hearing with respect to said vacation was scheduled for April 3, 1996 in accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of April 3, 1996; and WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and WHEREAS, the Council did hold a public hearing on Ap6l 3 t�)!•6 to inform any and all interested parties relevant to the vacation of a sewer easement in the ix.,Jiwest 1/4 of the southwest 1/4 of Section 26, Township 118, Range 22; and WHEREAS, it was determined by the City Council that said easements were not needed for public purposes; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the following sewer easement be vacated: A parcel in that part of the northwest 1/4 of the southwest 1/4, Section 26, Township 118, north of Range 22 west described as follows: Commencing at an iron monument on the south line of said subdivision, 649.2 feet east of the southwest corner of said subdivision; thence north parallel with the west line of said subdivision, 627.5 feet; thence east to a point on the east line of said subdivision, 671 feet south of the northeast corner of said subdivision; thence south along the east line of said subdivision to the southeast corner thereof; thence west along the south line of said subdivision to the point of beginning, which said parcel is described as follows: Commencing at the southwest corner of the above described tract; thence north along the west line of said tract distance of 33 feet, thence east along a line parallel to the south line of said tract a, distance of 170 feet; thence north along a line par tllel to the west line of said tract, a distance of 50 feet; thence east along the line par;.11el to the south line of said tract to a point 83 feet north of said south line and 180 feet west of the east line of said tract; thence in a northeasterly direction to a point 183 feet north of the south line of the said tract and 80 feet west of the east line of said tract; thence north parallel to the east line of said tract, a distance of 260 feet; thence e; st along a line parallel to the south line of said tract to a point on the east line of said tract; thence south along the east line of said tract to the southeast corner of said tract; thence west along the south line of said tract to the point of beginning and there terminating. 0AV.NUIPACATI0M9ISWALMIUPI LCIS 19U1 DK • • RESOLUTION NO. 96- 204 Page Two FURTHER BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the Mayor and City Manager are authorized to sign the Quit Claim Dads releasing easements recorded under Document No's 905647 and 851962.
