CITY OF PLYMOUTH
RESOLUTION NO. %-203
AUTHORIZING THE VACATION OF
A STORM SEWER EASEMENT REFERENCED AS
PARCEL 19 IN DOCUMENT NO, 905647
WHEREAS, a petition was received to vacate a storm sewer easement in the northwest 1/4 of
the southwest 1/4 of Section 26, Township 118, Range 22; and
WHEREAS, said petition was signed by a majority of the owners of the land abutting the area
proposed to be vacated; and
WHEREAS, a public hearing with respect to said vacation was scheduled for April 3, 1996 in
accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks prior
to the meeting of April 3, 1996; and
WHEREAS, all property owners adjacent :,I the proposed vacation were duly notified by trail;
and
WHEREAS, the Council did hold a public hearing on April 3, 1996 to inform any and all
interested parties relevant to the vacation of a storm sewer easement in the northwest 1/4 of
the southwest 1/4 of Section 26, Township 118, Range 22; and
WHEREAS, it was determined by the City Council that said easements were not needed for
public purposes;
NOW, THEREFORE, BE
IT HEREBY RESOLVED
BY THE
CITY COUNCIL OF THE
CITY OF PLYMOUTH,
MINNESOTA: That the
following
storm sewer easement be
vacated:
An 80 foot strip of land lying within that part of the northwest 1/4 of the
southwest 1/4 of Section 26, Township I18, north of Range 22, west described
as follows: Commencing at an iron monument nn the south line of the said
subdivision 649.2 feet east of the southwest corner of said subdivision; thence
north parallel with the west line of said subdivision, 627.5 feet; thence east to a
point on the east line of said subdivision, 671 feet south of the northeast corner
of said subdivision; thence south along the east line of said subdivision to the
southeast corner thereof; thence west along the south line of said subdivision to
the point of beginning.

The centerline of which strip is described as foil3ws: Beginning at a point on
the northerly line of Lot 8, Block 4, Beacon Hf:ights Second Addition, distant
36.5 feet easterly from the northwest corner of said Lot 8; thence north easterly
to a print on the westerly line of the northeast quarter of the southwest quarter
of Section 26, distant 422 feet north of the center of the southwest 114 of
Section 26 and there terminating.
and
A permanent easement over that part of the above described parcel lying within
a 40 foot strip of laud centered upon the above described centerline as iden-ifit;d
as Parcel No. 19 and Document No. 905647.
FURTHER BE IT HEREBY RESOLVED BY TI73 CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA: That the Mayor aed City Manager are authorized to sign the
Quit Claim Deeds releasing easements recorded urrler Document No's 905647 and 851962.
Adopted by the City Council on April 3, 1996.
