CITY OF PLYMOUTH
RESOLUTION NO. % - 202
AUTHORIZING THE VACATION OF
A STORM SEWER
EASEMENT DESCRIBED
AS PARCEL NO. 18 IN DOCUMENT NO. 905647
WHEREAS, a petition was received to vacate a storm sewer easement in Lot 8, Block 4,
Beacon Heights, 2nd Addition; and
WHEREAS, said petition was signed by a majority of the owners of the land abutting the area
proposed to be vacated; and
WHEREAS, a public hearing with respect to said vacation was scheduled for April 3, 1996 in
accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks prior
to the meeting of April 3, 1996; and
WHEREAS, all property owners adjacent to the prop,)sed vacation were duly notified by mail;
and
WHEREAS, the Council did hold a public hearing on April 3, 1996 to inform any and all
interested parties relevant to the vacation of a storm sewer easement in Lot 8, Black 4, Beacon.
Heights, 2nd Addition; and
WHEREAS, it was determined by the City Council that said easements were not needed for
public purposes;
NOW, THEREFORE;, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PLYMOUTH, MINNESOTA: That the following storm sewer easement be
vacated:
That part of Lot 8, Block 4, Beacon Heights Second Addition described as
follows: Beginning at the northwest corner of Lot 8; thence easterly along the
northerly line of Lot 8 for a distance of 74 feet; thence south 43 degrees, 24
minutes west to the southwesterly line of Lot 8; thence northwesterly along said
southwesterly line to the point of beginning.
ITT
A permanent easement over that part of Lut 8 described as follows: Begi,tning
at the northwest corner of Lot 8; thence easterly along the northerly line of Lot
8 for a distance of 46 feet; thence south 43 dugrees, 24 minutes west to the
southwesterly line of Lot 8; thence northwesterly along said southwesterly line
to the point of beginning.

FURTHER BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA: That the Mayor and City Manager are authorized to sign the Quit
Claim Deeds releasing easements recorded under Document No's 905647 and 851962.
Adopted by the City Council on April 3, 1996.
