RESOLUTION N0. % -201
AUTHORIZING THE VACATION OF
A STORM SEWER EASEMENT
PARCEL 20 IN DOCUMENT NO. 905647
WHEREAS, a petition was received to vacate a storm sewer a°,,semen in 1te north 1/2 of the south 1/2 of
the northeast 1/4 of the southwest 1/4 of Section 26, Township 118, Range 22; and
WHEREAS, said petition was signed by a majority of the owners of the land abutting the area proposed to
be vacated; and
WHEREAS, a public hearing with respect to said vacation was scheduled for April 3, 1996 in accordance
with Minnesota Statutes 412.851 and the City Charter Section 12.06; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the
meeting of April 3, 1996; and
WHEREAS, all property owners adiacent to the proposed vacrttion were duly notified by mail; and
WHEREAS, the Council did hold a public hearing on April 3, 1996 to inform any and all interested
parties relevant to the vacation of a storm sewer easement in the north 1/2 of the south 1/2 of the northeast
1/4 of the southwest 1/4 of Section 26, Township 118, Range 22; and
WHEREAS, it was determined by the City Council that said easements were not needed for public
purposes;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA: That the following storm sewer easement be vacated:
That part of the north 1/2 of the south 1/2 of the northeast 1/4 of the southwest 1/4 of
Section 26, Township 118, north of Range 22 west lying within an 80 foot strip of land the
centerline of which is described as follows: Beginning at a point on the westerly line of
said subdivision, a distance of 422 feet north of the center of said section; thence
northeasterly to a point on the northerly boundary of said subdivision, a distance 289.1 feet
west of the northwest corner of said subdivision and there terminating.
FURTHER BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA: That the Mayor and City Manager are authorized to sign the Quit Claim Deeds releasing
easements recorded under Document No's 905647 and 851962.
Adopted by the City Council on April 3, 1996.
