HomeMy WebLinkAboutCity Council Resolution 1996-161M CITY OF PLYMOUTH RESOLUTION S+6-161 APPROVING MPUD PRELIMINARY PLAN AMENDMENT, CONDITIONAL USE PERMIT, AND FINAL SITE PLAN FOR WELSH COMPANIES FOR PROPERTY LOCATED NORTHEAST OF ANNAPOLIS LANE AND 34TH AVENUE (96006) WHEREAS, Welsh Companies has requested an F 1PUD Preliminary Plan Amesiment, Conditional Use Permit, and Final Site Plan for Plymouth Business Center -- Phase 5, for property legally described as follows: Lot 1, Block 1, Plymouth Business Center 5th ,addition. WHEREAS, the Planning Commission has review.,d said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE Cr Y OF PLYMOUTH, MINNESOTA, that it sh.juld and hereby does approve the request by Welsh Companies for an MPUD Preliminary Plat! Amendment, Conditional Use Permit, and Final Site Plan for Plymouth Business Center -- Phase 5, subject to the following conditions: 1. This approval permits the construction of ,wo office/warehouse buildings on this site. Building A (southernmost building) is approved for 73,979 square feet and Building B (northernmost building) is approved for 50,235 square feet, in accordance with the plans received by the City on February 16, 1996, 4 xcept as amended by this resolution. 2. Maximum impervious surface coverage for this lot shall be 39 percent. 3. Building A shall not exceed 50 percent office use, and Building B shall not exceed 65 percent office use. 4. Approval by the Bassett Creek Drahiage District prior to issuance of building permits. 5. All waste and waste containers shall be stored within the buildings. 6. Prior to issudnca of building permits, the applicant shall submit revised plans that include or identify the following: a. Signage setback from the lot lines. b. Building setback dimensioned from lot line rather than utility easement line. c. Note that rooftop equipment that Is not required to be screened from residential property shall be painted to match the building. d. Identify the Shoreland Overlay District on the pian. e. Identify building and parking setbacks from the shoreland. • Resolution 96- ibl , Page 2 7. Submittal of 30 foot wide trail easements on both the north and south side of Plymouth Creek as approved by the Parks Director, prior to issuance of building permits. The City will construct a trail in one of these easements and the othet easement will be vacated and will revert back to the landowner. 8. Compliance with Item #12 of Resolution 90-817 (approving the original MPUD Preliminary Plan/Plat and Conditional Use Permit) requiring a 30 -foot wide conservation easement on Lot 2, Block 2, Plymouth Business Center 5th Addition, and also requiring the planting of two rows of coniferous trees within such easement. The Site Improvement Performance Agreement shall include these required trees. 9. Standard Conditions: a. Compliance with the City Engineer's Memorandum. b. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. c. Submission of the required Financial Guarantee and Site P-r•:ormance Agreement for completion of site improvements within twelve months of the Ll,aa rf this Resolution. d. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. e. Removal of all hazardous trees at the owners expense. f. Any signage shall be in compliance with the MPUD for Plymouth Business Center. g. Compliance with the Ordinance regarding the location of fire hydrants, fire lanes, and fire lane signage. h. An 8 1/2 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. i. Submission and approval of fire flow calculations prior to the issuance of building permits. j. The permit is subject to all applicable codes, regulations and ordinances, mid violation thereof shall be grounds for revocation. k. Park dedication fees shall be cash fees in lieu of land dedicatiun in accordance with the dedication policy in effect at the time of building permit issuance.
