HomeMy WebLinkAboutCity Council Resolution 1996-160• CITY OF PLYMOUTH RESOLUTION 9(- 160 APPROVING RESIDENTIAL PLANNED UNIT DEVELOPMENT (RPUD) PRELIMINARY PLAN/PLAT AND CONDITIONAL USE PERMIT FOR ORRIN THOMPSON HOMES FOR PROPERTY LOCATED NORTHEAST OF DUNKIRK LANE NORTH AND ROCKFORD ROAD (95139) WHEREAS, Orrin Thompson Homes has requested approval of an RPUD Preliminary Plan/Plat and Conditional Use Permit to allow development of approximately 14.8 acres located northeast of Dunkirk Lane and Rockford Road; The property is more specifically described as: Outlot A, Sugar Hills Addition, according to the recorded plat thereof, Hennepin County, Minnesota. ALSO Outlot A, Westbranch 3rd Addition, according to the recorded plat thereof, Hennepin County, Minnesota. ALSO Outlot F, Plymouth Presbyterian Church, according to the recorded plat thereof, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of Orrin Thompson Homes for an RPUD Preliminary Plan/Plat and Conditional Use Permit for property located northeast of Dunkirk Lane ^nd Rockford Road, subject to the fallowing conditions: 1. RPUD Preliminary Plan/Plat and Conditional Use Permit approval is hereby granted for Westbranch 4th Addition in accordance with the plans received by the City on Febtuary 12, 1996, except as amended by this res3lution. 2. Development standards for the single family lot (Block 1) shall be as foilowa: a. Front yard -- 25 -foot minimum setback b. Side yard -- 10 -foot minimum setback c. Lot cove%. -- 20 pet�ent maximum d. Lot area -- 10,010 square feet minimum 11 • Resolution 96- 160 , Page 2 of 3 3. Development standards for the twin home lots (Blocks 2-12) shall be as follows: a. 254cot minimum front yard setback from street right-of-way b. 10 -foot minimum setback from subdivision property line c. 20 -foot minimum setback between buildings d. S0 -foot minimum setback to Rockford Road and Dunkirk Lane North e. 15 -foot minimum setback to wetland buffer f. Lot area — 3,360 square feet minimum g. Lot coverage -- 100 percent maximum (for each individual lot) 4. Approval of a Wetland Mitigation Plan prior to the issuance of grading permits and submission of the RPUD Final Plan/Plat. 5. Additional transitional screening and berming shall be provided along Rockford Road anal Dunkirk Lane North. The plan indicating such additional transitional screening and berming shall be submitted with the Final Plan/Plat. 6. The Final Plan/Plat submission shall indicate the minimum dimensions between the homes and the wetland edges, as follows: a. Lot 1-2, Block b. Lot 2, Block 4 c. Lot I. Block 5 d. Lot 1-2, Block 9 e. Lot 1, Block 12 -- 40 -foot setback -- 55 -foot setback — 75 -foot setback -- 45 -foot setback -- 35 -foot setback 7. Compliance with Policy Resolution 39-439 regarding Tree Preservation. S, Payment of park dedication fees -in -lieu of dedication in accordance with the Dedication Policy in et►eect at the time of recording the Final Plat. 9. The Final Plan/Plat shall comply with Section 500.17, Subdivision 2 relating to adequate provision for looping of the utility system. 10. The applicant shall establish a 15 foot wide average buffer around the medium quality wetland, and a 20 foot wide average buf;�r around the high quality wetland. Prior to the issuance of building permits, buffer monuments shall be placed in accordance with Section 6, Subdivision C.7 of the Zoning Ordinance. ',1. The Homeowners Association documents shall include ownership W maintenance of Outlot A. 12, Standard Conditions: a, Compliance with the City Engineer's Memorandum. b. Removal of all hazardous trees from the property at the owner's expense. 0 Resolution 96- 160 • Page 3 of 3 c. No building permits shall be issued until a contract has been awarded for sewer and water. d. No building permits shall be issued until the Final Plat is filed and recorded with Hennepin County. e. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. f. Street names shall comply with the City Street Naming System. g. Final Plat mylars shall refer to RPUD 92-7. h. Appropriate legal documents regarding Homeowners Association documents, covenants and restriction as approved by the City Attorney shall be filed with the Final Plat. i. Private driveway access shall be limited to internal public roads and restricted from Dunkirk Lane and County Road 9. j. Any signage shall comply with the Sign Ordinance. k. Submission of the required Financial Guarantee and Site Performance Agreement for completion of site improvements within twelve months of the date of Final PlanTlat approval. 1. The Developer shall hold the City and its officers, employees, and agents harmless from claims made by itself and third parties for damages sustained or costs incurred resulting from plat approval and development. The Developer stall indemnify the City and its officers, employees, and agents for all costs, damages, or expenses which the City may pay or incur in consequence of such claims, including attorneys' fees.
