APPROVING FINAL PLAT AND DEVELOPMENT CONTRACT FOR ENTRY
ONE, INC. FOR "JARNES ADDITION" LOCATED SOUTH OF 43RD AVENUE
AT TRENTON LANE (95129)
WHEREAS, Entry One, Inc. has requested a Final Plat approval James Addition
located south of 43rd Avenue at Trenton Lane (generally located at 10440 Rockford
Road); and
WHEREAS, the City staff has prepared a Development Contract covering the
improvements related to said plat;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve
the Final Plat and Development Contract for Jaynes Addition located south of 414
Avenue at Trenton Lane, and,
FURTHER, that the Development Contract for said plat be approved, and that the
Mayor and City Manager be authorized to execute the Development Contract on behalf
of the City, and,
FURTHER, that the following conditions be met prior to filing of the said Plat:
1. Final Plat approval is hereby granted for Jaynes Addition in accordance with the
plans received by the City on December 29, 1995, except as amended by this
resolution.
2. This resolution approves a Conditional Use Permit and Site Plan icr the
development of two (2) two-family dwellings, together with the existing single
family dwelling on the site.
3. Minimum setbacks shall be as follows:
a. Front yard: 25 feet
b. Side yard: 20 feet
c, County Road 9: 50 feet
d. Principle building setbacks between Lots 2 and 3, and between
Lots 4 and 5 are approved at zero feet.
4. Prior to issuance of building permits, the City's Water Resources Engineer shall
field verify the findings of the December 13, 1995 Wetland Report.

5. The developer and his assigns shall not gain access to the site by crossing the City
Trail which runs along County Road 9. This trail is to be kept free of construction
equipment, construction materials, and debris at all times during the construction
period.
6. The existing concrete slab in &e southeast corner of the site shall be removed prior
to issuance of building permits.
7. Compliance with the City's Tree Preservation Ordinance.
8. Submittal of a revised Landscape/Reforestation Plan reflecting that no more ttian 25
percent of the trees would be from any one species, and reflecting native plant
materials. Such revised plan shall be subject to approval by the Cir Forester prior
to filing the Final Plat.
9. Standard Conditions:
a. Compliance with the City Engineer's Memorandum.
b. Removal of all hazardous trees from the property at the owner's expense.
c. No building permits shall be issued until a contract has been awarded for sewer
and water.
d. No building permits shall be issued until the Final Plat is filed and recorded
with Hennepin County.
e. Compliance with Policy Resolution 79-80 regarding minimum floor elevations
for new structures on sites adjacent to, or containing any open storm water
drainage facility.
f. Submittal of required utility and drainage easement documents as approved by
the City Engineer prior to filing the Final Plat.
g. Payment of park dedication fees -in -lieu of dedication in accordance with the
Dedication Policy in effect at the time of recording the Final Plat.
h. No yard setback Variances are granted or implied.
I. Private drive access shall be limited to 43rd Avenue and restricted from
Rockford W)ad.
j. Any signage shall comply with the Sign Ordinance.
k. Submission of the inquired Financial Guarantee and Site Performance
Agreement for completion of site improvement. within twelve months of the
date of this resolution.
1. The Developer shall hold the City and its offlcers, employees, and agents
harmless from claims made by itself and third parties for damages sustained or
costs incurred resulting from plat approval and development. The Developer
shall indemnify the City and its officers, employees, and agents for all costs,
damages, or expenses which the City may pay or incur in consequence of such
claims, including attorneys' fees.

m. The Development Contract, as approved by the City Council, shall be fully
executed prior to release of the Final Plat.
