RESOLUTION 96 - 93
REIMBURSING DEVELOPER FOR
THE EMBANKMENT FOR THE SOO LINE CROSSING AT
SCHMIDT LAKE ROAD CONSTRUCTION
NANTERRE ADDITION (94093)
WHEREAS, the City of Plymouth and Weston Corporation have entered into a
development contract dated October 13, 1995 for the development of Nanterre Addition;
and
WHEREAS, as part of this development, the developer was required to construct the
embankment for the Soo Line Crossing at Schmidt Lake Road in Nanterre Addition in
order to conform with the City of Plymouth's Thoroughfare Guide; cnd
WHEREAS, :n accordance with City policy the developer installed the required
embankment for the Soo Line Crossing in Nanterre Addition at Schmidt Lake Road; and
WHEREAS, the work has been completed as detailed in the approved plans and
specificat,wis; and
WHEREAS, it is the policy of the City of Plymouth to reimburse developers for required
unusual street construction upon completion in accordance with the approved plans and
specificatinns; and
WHEREAS, this amounts to $39,%0 plus $4,795 for engineering fees.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA: That the developer, Weston Corporation
is to be reimbursed In the amount of $44,755 which includes the engineering fee for the
required embankment construction for the Soo Line Crossing at Schmidt Lake Road based
on the construction plans and in accordance with City policy,
BE IT FURTHER RESOLVED that the funds be allocated from the MSA St►eet Fund,
Adopted by the City Council an February 7, 1996,
