HomeMy WebLinkAboutCity Council Resolution 1996-044• CITY OF PLYMOUTH RESOLUTION 96- 44 APPROVING FINAL PLAT AND DEVELOPMENT CONTRACT FOR LUNDGREN BROS. CONSTRUCTION COMPANY FOR "SAVANNAH SECOND ADDITION" LOCATED SOUTH OF SCHMIDT LAKE ROAD AND EAST OF FERNBROOK LANE (95021) WHEREAS, Lundgren Bros. Construction Company has requested Final Plat approval for Savannah Second Addition located south of Schmidt Lake Road and East of Fernbrook Lane; and, WHEREAS, the City staff has prepared a Development Contract covering the improvements related to said plat; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the Final Plat and Development Contract for Savannah Second Addition located south of Schmidt Lake Road and East of Fernbrook Lane, and, FURTHER, that the Development Contract for said plat be approved, and that the Mayor and City Manager be authorized to execute the Development Contract on behalf of the City, and, FURTHER, that the following conditions be met prior to filing of the said Plat: 1. Final Plat approval is hereby granted for Savannah Second Addition in accordance with the plans received by the City on April 12, 1995, except as amendod by this r..aolution. 2. Payment of park dedication fees -in -lieu of dedication in accordance with the Dedication Policy in effect at the time of filing the Final Plat with Hennepin County. 3. Private driveway access shall be limited to internal public roads and prohibited from Fernbrook Lane. 4. Minimum setbacks shall be as follows: a. Front yard: 25 feet b. Side yard: 10 feet c. Rear yard: 20 feet 5. Standard Conditions: a. Compliance with the City Engineer's Memorandum. b. Removal of all hazardous trees from the property at the owner's expense. Resolution 96-44 , Page 2 of 2 c. No building permits shall be issued until a contract has been awarded for municipal sewer and water, and the MPCA Permit has been issued. d. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. e. No building permits shall be issued until the Final Plat is filed and recorded with Iiennepin County. f. Submittal of required utility and drainage easement documents as approved by the City Engineer prior to filing the Final Plat. g. No yard setback Variances are granted or implied. h. Street names shall comply with the City Street Naming System. L Compliance with the City's Tree Preservation Policy. j. Compliance with the Ordinance regarding the location of fire hydrants and fire lanes. k. Fire flow calculations shall be approved by the Fire Division prior to issuance of building permits. 1. Any signage shall be in compliance with the Zoning Ordinance. in. Appropriate legal documents regarding Homeowner Association covenants and restrictions, as approved by the City Attorney, shall be filed with the Final Plat. n. The Development Contract, as approved by the City Council, shall be fully executed prior to release of the Final Plat. Adopted by the City Council on January 23, 1996.
