HomeMy WebLinkAboutCity Council Resolution 1996-043a CITY OF PLYMOUTH RESOLUTION 96- 43 I 1: '1 • I: 0) tJiv, 1:1 '•' •••':1' • :� 1: •' • :i' • WHEREAS, Caliber Development has requested an MPUD Preliminary Plan Amendment, Conditional Use Permit Amendment, Final Plan and Final Plat for Northwest Business Campus for property legally described as follows: Northwest Business Campus, 11th Addition, Lot 1, Block 1. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Caliber Development for an MPUD Preliminary Plan Amendment, Conditional Use Permit Amendment, Final Plan and Final Plat for Northwest Business Campus subject to the following conditions: 1. This approval permits the construction of a 70,000 square foot office/warehouse building, in accordance with the plans received by the City on December 29, 1995, except as amended by this resolution. 2. Any signage shall be in compliance with the MPUD for Northwest Business Campus. 3. All waste and waste containers shall be stored within the trash and recycling enclosure structure. 4. Retention of the existing vegetation on the north side of this site shall provide the required screening for the loading area and the rooftop units from the residential area north of the property. 5, Impervious coverage shall be 50 percent. Flexibility is granted due to the unique conditions related to this site: A. the building site was created under previous, less restrictive regulations B. previously approved site grading to remove portions of this site from the flood plain of Plymouth Creek have been completed. • • 95131, Page 2 C. D. the proposed development would meet the previous Shoreland requirements and would insult in zero percent impervious coverage within the 300 -foot Shoreland Overlay District. the site would be unbuildable for the land uses approved on the property if the 25 percent maximum impervious coverage requirement was enforced. 6. The approved plans include a wetland buffer of between 35 and 40 feet in width. The required water quality pond and park trail may be located within the buffer. 7. Prior to issuance of building permits, buffer monuments shall be placed in accordance with Section 6, Subdivision C. 7 of the Zoning Ordinance. 8. Standard Conditions: A. Compliance with the City Engineer's Memorandum. B. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. C. Submission of the required Financial Guarantee and Site Performance Agreement for completion of site improvements within twelve months of the date of this Resolution. D. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. B. Compliance with the Ordinance regarding the location of fine hydrants, fire lanes, and fire lane signage. F. An 8 1/2 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. G. Submission and approval of fire flow calculations prior to the issurnce of building permits. H. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. I. Park dedication fees shall be cash fees in lieu of land dedication in accordance with the dedication policy in effect at the time of building permit issuance. J. Submittal of trail easements prior to issuance of building permits. K. The developer shall construct an eight -foot park trail within the trail easement along Plymouth Creek. The developer will be reimbursed for the actual cost of paving. The grading, base preparation and suitable ground cover shall be provided by the developer. L. The Developer shall hold the City and its officers, employees, and agents harmless from claims made by itself and third parties for datnages sustained or costs incurred resulting from plat approval and development. 'The Developer shall indemnify the City and its officers, employees, and agents for all costs, damages or expenses which the City may pay or incur in consequence of such claims, including attorneys' fees. • 95131, Page 2 • M. No building permits shall be issued until the Final Plat is filed and recorded with Hennepin County. N. Final Plat mylars shall refer to MPUD (81-1). Adopted by the City Council on January 23, 1996.
