REIMBURSING DEVELOPER FOR
REQUIRED 12 INCH TRUNK WATERMAIN CONSTRUCTION
ORCHARDS OF PLYMOUTH ADDITION (94050)
WHEREAS, the City of Plymouth and ABINGDON Development Corporation have
entered into a development contract dated November 9, 1994 for the development of
Orchards of Plymouth Addition; and
WHEREAS, as part of this development, the developer was required to construct a 12
inch watermain in Orchards of Plymouth Addition in order to conform with the City of
Plymouth's Water Distribution Plan; and
WHBR1iAS, in accordance with City policy the developer instalied the required 12 inch
watermain in Orchards of Plymouth Addition in 39th Place North and between Lot 2,
Block 4 and Lot 1, Block 5 from 39th Place North to the south plat line; aid
WHEREAS, the City of Plymouth has previously accepted the utilities, including the 12
inch watermain, for continual maintenance as of January 9, 1996; and
WHEREAS, it is the policy of the City of Plymouth to reimburse developers for required
watermain construction upon completion in accordance with the approved plans and
specifications and acceptance for continual maintenance by the City; and
WHEREAS, this amounts to $15,991.83 which includes engineering fees.
NOW, THEREFORE, BE IT HEREBY RESOLV13D BY THE CITY COUNCIL OF THE
CITY OF PLYMOUTH, MINNESOTA: That the deve'oper, ABINGDON Development
Corporation is to be reimbursed in the amount of $15,991.83 for the required 12 inch
watermain construction based on the aligAment in the construction pans and in accord,nce
with City policy.
BE IT FURTHER RESOLVED that the funds be allocated from the Trnnk Water Fund.
Adopted by the City Council on ?anuary 9, 1996.
