HomeMy WebLinkAboutCity Council Resolution 1996-012• CITY OF PLYMOUTH RESOLUTION % - 12 APPROVING LOT DIVISION AND VARIANCE FOR DAVANNI'S, INC., FOR PROPERTY LOCATED NORTH OF HIGHWAY 55 AND SOUTH OF HARBOR LANE, ABOUT 700 FEET WEST OF FERNBROOK LANE (95119) WHEREAS, an application has been filed by Davanni's, Inc. which requests approval of a Lot Division and Variance to divide a parcel of land generally located north of Highway 55 and south of Harbor Lane, about 70u ieet west of Fernbrook Lane, as legally described ou Attachment One, attached hereto and hereby made a part hereof, and WHEREAS, the proposed lot arrangement for which the Lot Division is sought is as legally described on A'tachment Two, attached hereto and hereby made a part hereof; and WHEREAS, the Variance would allow creation of a commercial lot (Parcel B) without frontage on a public street, and WHEREAS, the Planning Commission has fully considered the request for the Lot Division and Variance, and recommends approval. NOW, THEREFORE, BE TI' HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the regt,est of Davanni's, Inc. for a Lot Division and Variance, subject to the following conditions: 1. No building permits shall be issued until the Lot Division is filed and recorded with Hennepin County, 2. No building permits shall be issued until all required park dedication fees are submitted to the City. 3. Submittal of recorded cross access easement documents prior to filing of the Lot Division. 4. Submittal of recorded sanitary sewer easement documents prior to filing of the Lot -Division. 5. Submittal of drainage and utility easement documents as approved by the City Engineer prior to filing of the Lot Division. l: Resolution No. 96-12 , Page 2 of 5 6.
