CITY OF PLYMOUTH
RESOLUTION 96- 11
APPROVING A CONDITIONAL USE PERMIT, SITE PLAN AND VARIANCE
FOR WEST LUTHERAN HIGH SCHOOL FOR PROPERTY LOCATED AT THE
SOUTHEAST CORNER OF HARBOR LANE AND 34TH AVE. N. (95116)
WHEREAS, Wayne Jeske Associates has requested a Conditional Use Permit, Site
Plan and Variance for a private high on property legally described on the attached
Exhibit A; and
WHEREAS, the Planning Commission has reviewed said request at a duly called
Public Hearing and recommends approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve
the request of Wayrt Jeske Associates for a Conditional Use Permit, Site Plan and
Variance for a private high school located at the southeast corner of Harbor Lane and
34th Ave. N, subject to the following conditions:
1. The Site Plan is for the construction of a 24,288 square -foot private high
school building in accordance with the plans received on December 1, 1995,
except as amended by this resolution.
2. The Conditional Use Permit is for a private high school serving grades 9
through 12 with a maximutn enrollment of 150.
3. A Variance is granted for the placement of a six-foot fence within the front
yard setback as shown on sheet A1.2.
4. Prior to issuance of building pertnits, architectural detailing shall be added
along the roofline of the gymnasium.
5. A Variance is granted from the Fire Code. A fire lane is not tNuired on
the west side of the building.
6. The approved landscaping plan includes the use of seed it the areas shown
for playfields, future building and parking expansion e.eas.

7. Standard Conditions:
a. Compliance with the City Engineer's Memorandum.
b. Compliance with Policy Resolution 79-80 regarding minimum floor
elevations for new structures on sites adjacent to, or containing any open
storm water drainage facility.
c. Submission of required financial guarantee and Site Improvement
Performance Agreement for completion of site improvements within 12
months of the date of this resolution.
d. Any signage shall be in compliance with the Ordinance.
e. Any subsequent phases or expansions are subject to required reviews and
approvals per Ordinance provisions.
f. Compliance with the Ordinance regarding the location of fire hydrants and
fire lanes except as amended by this resolution.
g. All waste and waste containers shall be stored in the trash enclosure shown
on the plans, and t►o outside storage is permitted.
h. An S 1/2 x 11 inch "As Built" Fire Protection Plan and a 24 x 36 inch mylar
"As Built" utility plan shall be submitted prior to the release or reduction of
any site improvement bonds per City Policy.
i. The permit is subject to all applicable codes, regulations and ordinances,
and violation thereof shall Lie grounds for revocation.
J. The site shall be maintain -d in a sanitary manner.
k. No building permits shall be issued until the Lot Consolidation is filed with
Hennepin County.
Payment of park dedication fees -in. lieu of dedication in accordance with the
Dedication Policy in effect at the time of building permit issuance.

That part of Lot 3, Block 2, lying north of the south 166.00 feet thereof, and all of Lot
4, Block 2, FOX MEADOWS FIRST ADDITION, according to the recorded plat
thereof, Hennepin County, Minnesota together with an easement for ingress and
egress, over the north 12 feet of the south 166 feet of Lot 3, Block 2, FOX
MEADOWS FIRST ADDITION, Lots 5 and 6, Block 2, FOX MEADOWS FIRST
ADDITION, according to the recorded plat thereof, Hennepin County, Minnesota.
