RESOLUTION yo. 95 - 718
AUTHORIZING THE VACATION OF
DRAINAGE EASEMENT FOR PONDING PURPOSES
OUTLOT A - PHEASANT TRAIL
WHEREAS, a petition was received to vacate certain i+rainage easement for ponding purposes in
Outlot A, Pheasant Trail; and
WHEREAS, said petition was signed by a majority of the owners of the land abutting the area
proposed to be vacated; and
WHEREAS, a public hearing with respect to said vacation was scheduled for November 21, 1,095 in
accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the
meeting of November 21, 1995; and
WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and
WHEREAS, the Council did hold a public hearing on November 21, 1995 to inform any and all
interested parties relevant to the vacation of a drainage easement for ponding purposes in Outlot A
Pheasant Trail Addition; and
WHEREAS, it was determined by the City Council that said easements were not needed for public
purpos.s;
NOW, `THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA: That the following drainage easement for ponding purposes be
vacated:
The drainage easements for ponding purposes within Outlot A, Pheasant Trail
according to the plat on file or of record In the office of the Registrar of Tides,
Hennepin County, Minnesota.
Adopted by the City Council on November 21, 1995.
