HomeMy WebLinkAboutCity Council Resolution 1995-707CITY OF PLYMOUTH RESOLUTION 9S - 707 APPROVING RESIDENTIAL PLANNED UNIT DEVELOPMENT FINAL PLAN/PLAT FOR SCHERBER PARTNERSHIP PROPERTIES LOCATED SOUTH OF OLD ROCKFORD ROAD AT 41ST PLACE NORTH (95027) WHEREAS, Scherber Properties Partnership has requested an RPUD Final Plan/Plat for Holly Creek 4th Addition located south of Old Rockford Road at 41st. Place N.; and WHEREAS, the City staff has prepared a Development Contract covering the improvements related to said plat. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the RPUD Final Plan/Plat and Development Contract for Holly Creek 4th Addition, and, FURTHER, that the Development Contract for said plat be approved, and that the Mayor and City Manager be authorized to execute the Development Contract on behalf of the City; and, FURTHER, that the following conditions be met prior to recording of, and related to said plat: 1. RPUD Final Plan/Plat approval is hereby granted for the Holly Creek 4th Addition in accordance with the plans received by the City on October 12, 1995, except as amended by this resolution. 1. Minimum lot size shall be 17,050 square feet. 2. Maximum lot coverage shall be 20 percent. 3. Approved minimum lot width shall be 95 feet. 4. Development Standards: a. 25 -foot front yard setback b. 10 -foot side yard setbac}: to garages d. 25 -foot rear yard setback h. 15 -foot setback to wetland buffers Res,lution 95- 707, Page 2 S. Compliance with Section 6, Subdivision C of the Zoning Ordinance (Wetland Protection Ordinance). Required buffers as identified on the plans dated June 9, 19959 and FAhibit A dated June 23, 1995: a. 60 -font buffer for Lots 1, 7 and 8 b. 50 -foot buffer for Lots 4 and 5 C. 40 -foot buffer for Lots 2 and 3 d. a buffer is not required on Lot 6 6. The buffer plan shall comply with the plans received by the City on October 9, 1995. 7. The developer shall construct the trail to city specifications. The developer is responsible for the trail base preparation and suitable ground cover. The City will reimburse the developer for the cost of paving the bituminous trail. 8. Standard Conditions: a. Compliance with the City Engineer's Memorandum. b. Removal of all hazardous trees from the property at the owner's expense. c. No building permit shall be issued until a contract has been awarded for sewer and water. d. Payment of park dedication fees -in -lieu of dedication in accordance with the Dedication Policy in effect at the time of recording the Final Plat. e. Submittal of a 16 -foot trail easement prior to recording the Final Plat. e. Street names shall comply with the City Street Naming System. f. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. g. No building permits shall be issued until the Final Plat is filed and recorded with Hennepin County. h. Final Plat mylars shall refer to RPUD 92-1. i. Appropriate legal documents regarding Homeowners Association documents, covenants and restriction as approved by the City Attorney shall be filed with the Final Plat. j. Location and number of fire hydrants shall be approved by the Fire Division. k. Compliance with Policy Resolution 89-439 regarding Tree Preservation. Adopted by the City Council on November 21, 1995.
